OK, so, as predicted,
the IPCC investigations

into both of your cases find the
complaints are not substantiated,

and the most serious disciplinary
action that they recommended

was a... a few written warnings.

What about telling me that the CPS
had reviewed my case when it hadn't?

A "genuine mistake".

OK, and what about not telling me
that they found the drugs

that he used to sedate me
in my bloodstream?

They actually do find that
largely substantiated,

but they... they do want to note
that the investigating officer

at the time had, erm...
a "heavy workload".

What?

We now know that they didn't search

Worboys' house
when he was first arrested.

I was told that they did

and that they didn't find
anything incriminating.

But, actually,
the most incredible revelation

is of the CCTV footage
of you leaving the club that night.

They said that there was no sign
of me on the footage.

That's because they were looking
at the wrong night -

the 27th, not the 26th.

If they had the correct date,

they would have seen
that you left the club at 2am,

and they would have known
that Worboys was lying

when he said
he picked you up at 3:50.

The initial investigation
didn't even analyse

your mobile phone data,
which would have confirmed

when you got into his cab
and where he took you.

It's like a joke.

I'm guessing it doesn't get
any funnier for me?

No. Almost all the allegations in
your case, they say, are not proven.

You saying that you weren't
believed - not proven.

Being told not to show emotion
in your interview...

Well, DC Stephens even denies
ever saying that to you,

so it's your word against his.

The only concession is that
they agree that the guy living

in your old flat, Billy Houghton,
should have been interviewed.

And to cap it all off,
they've released a statement

saying that they have improved
training and changed procedures

so that none of this
will ever happen again.

It's what they always do.

Because, to be honest, this is only
making me even more determined.

and I don't believe the police have
sufficiently been held to account.

I think the impact
of what the police did to me

was worse
than the actual rape itself.

with a sense of guilt

for all the women
that came after me.

Even though I know
it's not my fault...

..I ask myself,
could I have done more to stop him?

I'm shocked
that you won't just admit liability.

The fact that you are fighting this

The police's position is that,
whilst we are, of course,

sympathetic to the undoubted trauma
you have both suffered...

..we do not admit any liability on
the part of the Metropolitan Police.

We believe the investigation
into the crimes of John Worboys

was reasonable,
ultimately successful.

It took you five years to work out
these attacks were linked.

Year after year,
he was left to roam the streets

and attack other women
when he should have been locked up!

What we would like to do, however,
is to invite you both to attend

a police training programme, present
your experiences to the attendees.

NBV told us that even after
she'd been sick in the toilets,

she still carried on drinking.

Did this have, er,
an impact on your assessment of NBV?

The CCTV footage of her
falling over at the campus

was entirely consistent
with the actions of someone

who had had too much to drink
that night.

I thought the whole thing was odd.

I thought it was odd
that an educated girl

would accept a drink from a stranger
in those circumstances.

DSD told us she had taken
some cocaine with her friends,

and this showed up subsequently
in her blood tests.

Had she also drunk alcohol
that evening

before getting into Worboys' cab?

Well, her friends told us
they put her into the cab

after their night out
because she was so out of it.

My conclusion was
that DSD had not sustained

any specific psychiatric injury
as a consequence of the rape.

She had, however,
suffered a depressive episode

as a consequence of how she had
been dealt with by the police.

Well, following the assault,
NBV developed symptoms

of post-traumatic stress disorder,
including nightmares,

intrusive imagery, flashbacks,

avoidance, anxiety and depression,

poor concentration
and social withdrawal.

She still suffers from moderate
to severe symptoms.

She can be tearful
and experiences mood swings.

And she suffers
from continuing sexual aversion

and a lack of sexual enjoyment.

Are you aware,
Inspector Underwood,

of a guide which outlines the Met's
standard operating procedures

for investigative techniques
in rape and sexual assault cases?

I am aware of it, yes.

It lays out detailed steps
and considerations to be followed,

from a starting point of treating
the victim's account as truthful,

does it not?

I don't know.

Why not, may I ask?

I just can't recall it
in any detail.

As a member of
one of the Met's Sapphire teams,

which are specialist rape and
sexual assault investigation units,

I find that quite an extraordinary
thing for you to say.

Well, in my opinion, it's not
something I consider practical

to apply to each and every case.

To this case?

I think these policies are fine
in theory...

but they're not always applicable
to day-to-day policing.

Then why have they been set out
by the Met as their guidelines?

I think
they have been created purely

to protect the police
from legal challenges.

If a case is not classified
as a serious sexual assault,

then details of the investigation
are not entered

into the Criminal Intelligence
Computer Database, are they?

No. Meaning no closing report
would need to be done, would it?

No.
Is that a good thing?

Honestly?

An opportunity to not have
to do one would be taken gladly.

Was there a drive from
your superiors at Borough Management

to disprove allegations of rape
and sexual assault?

Yes.
Why was that?

Because if an allegation
can be legally disproved,

then it would improve
detection rates.

So junior officers
were effectively encouraged

not to pursue allegations of rape
and sexual assault

and instead to focus
on other crimes such as burglary,

which were easier to clear up.
Is that right?

Broadly speaking, yes.

Coming now, DC Coldham,
specifically to the case NBV.

Even though her case bore
all the hallmarks

of a drug-facilitated
sexual assault,

she was not treated as such,
was she?

Personally, I believed her account.

But I knew there was no prospect
of the case being reopened

once the forensic
and toxicology results had come back

as inconclusive.

Even though there were still
many important leads

still to be followed up?

Yes.
So, under pressure from on high,

her case was not recorded
as a serious sexual assault,

supervision from more
senior officers did not occur,

and her case was not entered
into the data bases?

No.

And the case was cleared up
in three months.

No case closure report,

no detailed report entered
into the system.

And the Borough's clear-up rate
was thereby improved

since the case was not left
as unsolved.

Like I say, that... that was
the situation at the time.

a judicial review of the decision

on the grounds
that it was legally irrational

to release Worboys.

And we have to move fast.

to find out is that...

as late as 2015,
he was denied transfer

from a high-security prison
to a lower-security open prison

on the grounds that he posed
an unacceptable risk.

Yet two years later, they're saying
he's suitable for parole?

That sounds pretty irrational to me.

The thought of him being released
in just a few weeks is...

My Lords, this is a unique case,

in which someone
who has been granted his freedom

has then had it taken away from him.

If ever there was a case for the use
of the judicial review jurisdiction

to be exercised
with the greatest care

and anxious scrutiny...

this is that case.

We see that Mr Worboys has been
seriously minimising the nature

and extent of his offending

and has been dishonestly
manufacturing his explanation.

Furthermore, we say
the Board has failed

to take into account
critical evidence,

evidence which it was not
in its discretion to ignore.

Evidence which, if it was going
to reach a lawful decision,

it HAD to take into account.

In the notes of the sessions,
attended with the psychologists,

Mr Worboys admits responsibility

only for those offences
for which he was convicted.

A total of 19 offences

carefully selected by
the Crown Prosecution Service,

as you can see from their statement,

so as to not overload
the indictment.

These offences were against
a total of 12 women,

and Worboys says

his offending began
in September-October 2006.

But let's look, then,
at what evidence is out there,

because that evidence paints
a very, very different picture

to the one presented by Mr Worboys
to the Parole Board.

The police's conclusion, having
investigated all of the offences

that resulted in the charges
brought against Mr Worboys,

is that he committed offences
against a total of 105 women.

We submit
this is very powerful evidence

that Mr Worboys' offending
was more extensive

than anything he has admitted.

And, crucially,

we can see from the evidence given
to the police by the witness DSD,

we can see
that his offending went back to,

at the very least...

May 2003.

That is more than three years
before the date

he says is when he began offending,

which blows out of the water
the Parole Board's assessment

that he has taken
full responsibility

for his offences,

or that he has been open and honest
in his account.
