Last spring, one of our
great cities recoiled with

horror after a brutal
murder was committed by boys,

scarcely out of their
childhood, against another boy.

The trial that followed
was no less shocking because

society had to answer a cruel question.

Should we put teenagers to
death for killing other teenagers?

I covered the murder and trial in my
syndicated column, The Corruptors.

I talked to the young murderers
themselves, to their parents,

to the district
attorney who prosecuted them,

asking the same
question you will ask tonight.

Why?

Why did these youths kill?

Where was the corruption that paved the
way for this tragedy? Who was the corrupt?

In a few moments, you will see
this harsh and brutal crime.

What you will see has not only happened
time and time again in our own country,

but in every major city of the world.

Different faces, different
places, but the same story.

And somewhere out of these streets,

the fabric of a nightmare is
beginning to take grotesque shape.

Moving through a street such as this one,

where pleasures to suit both
the eyes and tastes are halved.

Here is the marketplace for
millions of souls racked up

one on top of the other like boxes of
eggs in a crate, each pulsing with life.

These people are headed somewhere.

Some are going to the movies.

Francis Jones and his girl
wanted to go to the movies,

but he's a little short of money.

Besides, it's a pleasant spring
evening for a walk, and the park is free.

These are the young murderers
who will kill Francis Jones.

The boy dancing with the girl is Ira.
He isn't 15 yet, and under the law,

cannot be tried for murder.

The husky one on top of
the crate is Tom Penny.

He's all of 16 and
powerful. They call him Giant.

Paul Bean is also 16. The gang calls him
Jazz because he digs dancing the most.

This boy is of Irish-Italian heritage.

His name is Tony McLaughlin.

His self-chosen nickname, Spider.

He's 17, and there's a
knife under his shirt.

The one with the olive skin is
Osolito, a boy troubled by nightmares.

He became 16 four days ago.

Tonight, his nightmares
will turn into grim reality.

In a park 20 blocks from here,
these boys will kill Francis Jones.

This will be no dream like
those from which Joselito

has awakened so often with a scream.

This will be the real thing.

A bomb ignited by imagined
hates and disappointments.

The explosion bewildering
to its innocent victim.

Suddenly, the nightmare
in which Joselito so often

finds himself reaches out
for its sacrificial lamb,

the thing against which they can vent
their wrath, their bitterness, their hate.

Then the one sober
moment when the animal pack

realizes it's irrevocably deep. Murder!

I was up all night, crying.

Won't bring him back,
but should do it anyway.

Except the wife, she can't even cry.

He was such a decent boy, Mr. Marino.

And they have to pick him for killing.

They won't get off, will they?

No, they'll be sent to a reformatory.

Is that enough?

When I was a kid, Things like this,
trouble, gangsters, reasons, something to gain,

but they didn't know
Francis. He didn't know them. Why?

Just bought a new suit.

Was wearing it for the first time.

The mirror trying on different ties.

He liked everything just right.

He never even broke a toy as a child.

He looked after his things.

I want them to die for
what they did to Francis.

I want them to die.

I want them to die.

I tried, Mr. Marina.

I tried my best after these folks was
killed in an accident last New Year's.

You tell them in your paper, I want
Tom to be treated the same as the rest.

I want him to get a
trial, just like a white boy.

But if he did what they say he did, I
want him to get just what he deserves.

Only this morning.

This morning, a guy
made a big joke out of my

name being the same as one of the killers.

What was I supposed to do? Come
out and tell him it was my kid?

There's no sense torturing
yourself anymore, Mr. Bean.

You have the wife to think about.

She's a big help.

Even after what he did? I
just don't know what else to do.

anything I ever loved in life. Actually,

I want protection for Janie, but
it's more than that for us, a lot more.

prosecuting four young people, and I...

I didn't want to order anybody else to
do it, and there were no volunteers.

Well, doesn't your staff believe
they're guilty? They believe all right, Paul.

They just don't know the
extent of responsibility.

mind once and for all.

You know, it's not just us here.
It's happening all over the world.

how responsible we're going to hold them.

and then they headed home.

Oh, you know Paul
Marino, Captain Mantiglione?

I've heard of him. You're going to
hear more about him. He's writing us up.

Well, it was probably just a crank call,

but I'm going to put a couple
of men in the house at night.

Put two on the ladies in a day, and I'm
going to put one on you too, John. Me?

Yeah, you. What, do you think
you're bulletproof or something?

Proud, maybe.

I'll admit I was scared, though. I
haven't been that scared since the war.

You're still at war, aren't you, John?

With the young punks, the young hoodlums,

the young murderers who are
turning our streets into a jungle.

But too many are still living in it.

You know, John, I'm almost
glad this came to your house.

Now maybe you can do

I'm going to try to do what's right for
the people of the state, for your family,

those four young people on trial.

For 40 years, Mr. Marino, 40 long
years, I have been in practice right here.

I've come a long way from
Blackstone and studying nights.

You ask me how much I've
learned in all that time.

I have to tell you, not much more
than I knew back in those days.

You know why, Mr. Marino?

I feel privileged to hear
your point of view, sir.

Because in all that time, human
nature hasn't changed one iota, not a bit.

Oh, different clothes,
perhaps, fancier desks.

But hate is still with us.

Good and evil.

Day and night. Plus and
minus. The opposites.

Conflict.

Is that why you feel about
these boys the way you do?

Let's say that I've never
been interested in revenge.

You're a paradox counselor.

An old-fashioned man who should believe
in using the rod, not spoiling the child.

Would using the rod
prevent wanton killings?

Has turning a cheek saved the
Francis Jones boy from being

struck down by a pack of
wild animals and murderers?

Take a good look at this murderer. There.

On the day of the tragedy, that
murderer was four days past 16 years of age.

Not so long ago, Mr. Marino, Children
are treated as adults in our courts.

Less than 200 years ago in England,

an eight-year-old boy was
hanged for stealing a loaf of bread.

In our own country, 75 years ago,

a 14-year-old boy was hanged
in Nebraska for stealing a cow.

Yes, times have changed.

There are some who will bemoan the
passing of our frontier spirit, the Old West.

Well, I thank God for it.

Today, in this state, a
child under 16 years of

age is deemed incapable
of committing a crime.

And upon the commission of a crime,

he's committed to a reformatory there to
be treated and cured. This is our law, Mr.

Marino, and it's a good one.

I'll remember that
tomorrow when I go into court.

General Sessions, where the four
young murderers will be tried.

This is the arena where their
lives, or the years of their lives,

will be placed in the balance.

A conflict reduced to testimony,
statements, arguments, rules of evidence,

but nevertheless fierce in its
unfolding and awesome in its results.

These are the defendants.

See how clean and
scrubbed and young they look.

These are their lawyers, each receiving
$1,250 for his three-month effort here.

These men, hand-picked, can make
half that much money in a single day.

Mr. Terran, sitting
here with his assistant,

will prosecute as
vigorously as they defend.

The judge, the Honorable George
Purcell, for whom the court has risen...

We'll act as umpire.

The trial will be composed of two parts.

The first determining who are the
boys responsible for the murder,

almost a foregone conclusion.

And the second phase, the
presentation of the pleas before the jury,

who determine the extent of
punishment in this state.

The trial will cost the state
$228,000. Mr. Terran will try.

He will search his conscience, and he
will try to make this trial meaningful.

May it please the
court, the state charges the

defendants with murder
in the first degree.

The state intends to
prove that at about 9 p.m.

on September 4th last year, the
defendants, Anthony McLaughlin, Jose Gomez,

Thomas Penny, Paul Bean, did with
malice aforethought, willfully, feloniously,

with intent,
deliberation, and premeditation.

Proceed to the place of the
murder, and there, with fists, boots,

and other weapons, beat Francis
Jones, then 18 years old, to death.

The state asks that the jury base
their verdict on the evidence presented,

and not upon the ages of the defendants.

The gauntlet was thrown and
the contest about to begin.

Not all would leave the
arena when it was over.

T.C. Muffet, Esquire,
would plead for the young

defendant's lives out
of his own principles.

And I would hang on to his every
word, waiting for that one flash,

that one insight into a
corruption so subtle.

It involved us all.

I want you to take a
good look at this murderer.

Under the law, this child
is construed to be a man.

Now look at him, this man.

Four days past 16 years of age at the
time of the crime, but for four days,

96 hours a long
weekend, he would not be here.

He would be in children's court
where they're trained to treat him.

Now this indictment reads
that Francis Jones was beaten

to death with fists,
boots, and other weapons.

Now look at this boy.

Really look at him.
Oh, Joselito was there.

But look at these hands.

Are they deadly weapons?

Are they?

And as to boots, he was
wearing soft canvas shoes.

Joselito was there, but the state?

Will not prove that he
carried a weapon. He did not.

Joselito was there, but
he did not do murder.

Will you tell us your name, please?

Eileen Wainwright.

Were you a friend of
the late Francis Jones?

Yes.

Were you going to marry him, Eileen?

I don't know.

On the night of September
4th last year, the night

he was... the night he
died, were you with him?

Yes.

Would you please tell the
jury just what happened?

That night, we thought we'd walk in the
park, Francis and I. I wanted to kiss him.

Should we run?

No, they'd catch you.

Hey, man, you wanted the Jayhawks?

This is the confession of Thomas Penny.

Don't bug me, man.

Like I told you, we
went there to talk peace.

We didn't mean for nobody to get hurt.

Were you carrying a
club with you that night?

Yeah.

And you hit the boy,
Francis Jones, with that club?

Yeah.

Now, man, I don't know.

You know, I saw a pack

to this wooly little
sheep in a movie once.

I cried.

Once there was this girl I liked.

She wanted to go walking in
General Patton Park one day.

They beat me up.

That chicken, she stood there
laughing at me. Yeah, I was only 15 then.

But I got a couple of guys together.

We paid that little girl a visit.

I'll bet she never forgot me.

You see, I learned something that night.

I only got two feet and two fists.

But I learned that when I
took a lot of guys along, man,

lot of fists to punch with.

all my hands could do to him.

It was a magnificent adventure for me.

I have an abstract
interest in destruction.

going to stick and do you in later.

I didn't want to hurt that kid.

But then I didn't want to be chicken.

Like all the guys were
hitting them and kicking them.

I couldn't do no less than that.

Harken unto your verdict
as it stands recorded.

You say you find the
defendant Anthony McLachlan,

guilty of the crime of
murder in the first degree.

defendant, Jose Gomez,

guilty of the crime of
murder in the first degree.

And you further find
the defendant, Tom Penny,

guilty of a crime of
murder in the first degree.

And you further find the defendant,
Paul Bean, not guilty as charged,

and not guilty of any lesser charge.

And so say all of you.

The first part of the trial was over,
and the verdict of guilty rendered.

But it was only the
beginning for the convicted boys,

with the exception of Paulie Bean,

who it was felt had not
contributed to the death of Francis Jones.

Since in this state the
actual punishment for the crime

is the jury's decision
rather than the judge's,

the more vital phase of the trial was
still to be argued before the people.

Somehow the spoilers don't do so good
around here, Mr. Marino. Good schools,

funny things for the young people to do.

Well, it's not all in where they live,

but somehow this world
isn't quite right for them.

You know, ten years ago,
if you'd have told me that,

I'd have told you to save it for
the preachers and the social workers.

Ten years ago, you weren't a captain.

How is she, John?

She's bad, Charlie. Bad. She's
going into surgery this afternoon.

Her eyes are open, you know. She
doesn't see anything. Her speech is altered.

The doctor says she's got a 50-50 chance.

And Katie?

Oh, she's under sedation.

Shall we...

This the boy? That's him. Want to make
the phone call, try to run me down? Yes.

How did he come into my life, Charlie?

What is he?

What are you, Teddy?

You think he got the way he is
yesterday or the day before?

How many years do you suppose this
thing has been showing? A long time, John.

Why didn't someone see it, John,
before he did a thing like this?

I saw it, John.

I saw it a long time ago, and a lot of
other people should have been seeing it.

What about the 1,000 American
juvenile cyclists that took

over a Mexican town and held
it in terror for 36 hours?

Or for those people who like to travel,

how about the 50 kids in southern
France that attacked the tourists,

or the juvenile riots in
Sweden at the Grand Prix?

And in Singapore.

In Singapore, where the teenagers gotten
to be a major power in the underworld.

Statistics, Mr. Moreno.

Statistics to stack up against T.C.
Muffet's museum of... of legal horrors.

This kid's name is Theodore Blaine.

When he was 10 years old,

he beat up his sister and was sent to
a religious correctional institution,

where he set the place on fire.

Then he went back to Children's Court.

Then he was sent to Seshheim,

because they had a good
psychiatric staff available there.

Then he went to the security annex at
Tarrytown, where they had an, I quote,

A larger psychiatric staff available.

Then an escape and a
beating and a stick-up.

And back to court as a wayward minor.

Then two years at a
state vocational school.

And after that, the mandatory release.

Now that brings us right
up to the present, John.

And that's 12 years.

12 years in state
correctional institutions.

Know this boy? Indeed, I know this kid.

I had to.

Why?

I think it's us against you, man.

Well, you did what you had to do.

Now it's up to the judge.

In this state, it's the jury that decides.

We'll have our sentence hearings while
the defense claims mitigation, shows reason,

Illicit sympathy pleads for mercy.

And the prosecution,
John? What will it do?

Whether or not these kids should
be put away for life or permitted

to return to the streets
after five short years.

My husband left me six years ago.

I've been on relief
when I don't get a job.

When our hoisy little
was five, he got sick.

He sleep all the time.

So his head hurt.

Sometimes he sees two things.

Double.

He has crazy dream.

Delirium.

Yes, yes, that's what it is.

That wasn't the disease he
had, was it, Mrs. Gomez?

No.

Sleeping sickness.

Sleeping sickness.

We take him to St. Mary's,
but they don't do him no good.

Now he don't sleep at all.

Sometimes he goes delirium.

He remember nothing when he's that way.

He still has this condition?

Yes.

I call Dr. William Provost to the stand.

He is suffering from the residual
effects of epidemic encephalitis,

commonly called sleeping
sickness. In the case of children,

behavior disorders are of a...

Restless and aggressive nature, cruelty
toward animals and toward other children.

Doctor, could you tell
us anything about this

boy's conduct on the night of the murder?

Well, in a severe pressure situation or
strain, he would be very susceptible.

Easily guided and ordered
around by the more dominating

and aggressive members of the gang.

Is there a cure, Doctor?

We can try to re-educate these
children, try to control the residual effects.

Can you control Jose Gomez, Doctor?

Can you treat him in such a manner
as to give some measure of guarantee

that he will not again in the
future murder another human being? No.

If it may please the court.

I have been requested
by my learned associates

to make the final plea for all these boys.

They have asked me to
do this not, I think,

in deference to my long
experience at the bar of justice,

but because I am an
old man, a grandfather.

They know that I have seen many
changes in the ways of our lives.

They know that I love children.

I ask mercy for these three boys,

the same kind of mercy you would ask me
to show if they were your own children.

And I sat where you
sit, and you Stood here.

Look, I beg of you, into your hearts.

Ask yourselves, is Joselito Gomez
a criminal, or is he a sick child?

It's not a pleasant duty
to punish young people.

Mr. Moffat has told you what he
believes, or perhaps what he wants to believe.

You have convicted them of murder,

and the state demands that
the punishment fit the crime.

Murder in the first
degree is the unlawful killing

of a human being with malice aforethought.

Implied when no
considerable provocation appears,

or when the circumstances
attending the killing are

such that show An
abandoned and malignant heart.

I want you to remember those
phrases. With malice aforethought,

an abandoned and malignant heart.

The murder of Francis Jones
was a terrible, terrible thing.

And I want you to remember that, too.

T.C. Moffat's a brilliant man.

He sees many things, but
some things he does not see.

He does not draw the
conclusion that would permit a

safe, sane, healthy,
orderly, just society to exist.

How responsible was
Joselito for what he did?

He is 16 years old with a
mind damaged by serious illness.

He can't vote.

He can't even sue without a
guardian because he is too young.

And yet, he was on trial for his life.

There is injustice here somewhere.

I beg of you not to make a worse mistake.

I beg you not to put him away for life.

I swear before God that had he killed my
own grandchild, I would love him still.

I would show him mercy.

Mr. Muffet sees that Jose Gomez is sick,

and that Anthony
McLaughlin and Thomas Penny were

caught up in a world
which they had not created.

But what he does not see is
That we would have no world at all

if they're not held
responsible for their actions in it.

As to Tom Finney and Tony McLaughlin,

I say to you that they
have done a terrible thing.

But I also say to you that
five years in prison is enough.

How many days is it? How many nights?

How many endless ticking
hours, minutes, seconds?

I ask you to think of your own days
and nights on the streets of this city.

Truly, you who have been
brought up on the city

streets Can look at
these children and say,

there but for the grace of God
go my children, my grandchildren.

They can be helped.

They can come out of prison still
young, still able to face life.

It is the opinion of Dr. Provost
that psychotherapy would not hold,

would not help in the case of Jose Gomez.

The belief that he can
be cured is an illusion.

It is not safe to again allow him
to walk the streets of the city.

If, as in some states, I
were forced to ask for

his life, It would be a
grim, terrible thing.

But better that than to have
him freed, perhaps to kill again.

I thank God that I have not
had to make that decision.

Would you barter their lives for a
harsh revenge which will not help

Francis Jones or his parents or
you or society or these three boys?

These boys who stand before you with
their lives in your hands and your hearts.

I beg the court's indulgence for a moment.

Would you like to recess, Mr. Muffet?

No.

Thank you, no, Your Honor. Mr.

Muffet says that Anthony
McLaughlin and Thomas Penny

were leaders, but they did not lead.

They were members of a pack.

Well, does this mean that the
members of a lynch mob are not

to be held responsible
because they were members of a mob?

Does it mean that the German Gestapo,
who marshaled the death of millions,

are not to be held
responsible for their actions

because they were
citizens of a country gone mad?

No, they must be held responsible,
otherwise we would have world chaos.

Everyone must be held responsible, must
be held accountable for their actions.

Every man born must accept the
responsibility of being, even children.

One final thing. The
state contends that Tom Penny

and Tony McLaughlin
were leaders of the pack.

This pack had a group
mind, terrible, savage mind.

But I do not believe that the boys who
formed This pack, which we, parents,

guardians, and state
permitted them to form,

I do not believe they
should be held individually

responsible for the actions of the pack.

We must break them up.

We must learn to
supervise our children again,

to lend purpose and
meaning to their lives.

That is the way we can pay
for the life of Francis Jones.

Are you going to let them walk the
streets again in five short years?

Mr. Muffet asks justice for them.

I ask justice for us, our
children, for the decent 90% of us,

including the millions of
teenagers who have not done murder,

who need our protection,
who have a right to it.

I ask justice for Frances Jones.

The Bible says, he who smiteth a man so
that he die shall surely be put to death.

I don't ask for that much.

For Anthony McLaughlin, life
imprisonment with provision for parole.

For Jose Gomez, life
imprisonment with provision for parole.

For Thomas Penny, Life
imprisonment with provision for parole.

The jury has passed sentence.

A not untypical sentence for a
crime of this nature in our society.

Of the young murderers, three
will spend five years in prison.

The other was sentenced to
a correctional institution.

The father of Francis Jones will say,
It's not fair. They got away with it.

They know they can get away with murder.

Eileen Wainwright will say, sooner or
later, somebody else is going to get killed.

John Terran feels that way, too.
