the events that occurred

outside the market on the day in

- One of the clerks told me that
a woman had just left the store

without paying for an item, so I
rushed out to stop her.

- What did you do?

- I called out for her to stop.

- Stop.
She wouldn't stop, so I figured
she must be trying to get away.

- So you decided to pursue her?
- Yes.

- It never dawned on you that
Mrs. Chambers,

who was at least 30 feet away,

and is hard of hearing, couldn't
hear you?

- No, I didn't know she was hard
of hearing.

Oh, my nose. You broke my nose.

She had a weapon.

- Oh, a weapon.
By that you mean,

the cane Mrs. Chambers uses to
help her walk.

- She broke my nose.

- When did you realize you had
accosted the wrong person?

- When the store clerk ran out
and told me that I had the wrong
woman.

- Your honor, counsel is
distorting the reason why we are
here today.

This hearing is against the
defendant for assaulting my
client

and for breaking his nose, which
would adversely affect his
acting career.

- Oh, please, Your Honor, let's
set aside for a moment the fact
that

Mr. Fallon hasn't worked as an
actor this century.

He is a security guard.

He's already admitted he
accosted the wrong woman,

a woman whose impaired hearing
made it impossible

for her to know Mr. Fallon was
behind her.

And that being attacked by a
total stranger,

she did what any sane person
would do.

She defended herself against a
man twice her size, a third her
age.

Please. No more questions.

I don't have any other choice

control.

[eerie music]

- Mr. Carter,

does this jacket

- Mr. Carter, when was the last
time you talked to Ron Garrison?

- Well at the radio station
after the show.

- You had an argument with him
in front of some of your
coworkers.

You were heard telling him that
you would only calm down

if he dropped dead.

- I was angry.

I mean, I just heard that I was
going, going to be canned from
the show.

I mean, I, I didn't mean it
literally.

- Well how do you explain Ron
Garrison's 911 call

with him begging for you not to
kill him?

- What?

- 911, what is the nature of
your emergency?

- Help.
- Can you identify yourself,

- Bob, help.

- Goodbye, Ron.

[loud gunshot]

- Sir, we've identified your
location and police units are en

- He was dead when I got there.

- Robert Carter, I'm placing you
under arrest

for the murder of Ron Garrison.

of killing? A listener?

- Ron, his partner.

radio will never be the

- I know, I know, it's not about
the check it's about the client.

But that's why I think we should
take the case.

- Why, do you know Bob Carter?
- No, but

I listen to his radio show
almost every day, and, you know,

he just doesn't sound like
somebody who's going to murder
anybody.

- You don't think?
- Ron is always the one playing
the crazy pranks on people,

doing the stupid stuff to
people, and Bob always

follows up afterwards, makes
sure people are alright,

make sure their feelings weren't
hurt.

- How,

alright, look, fine.

I'll look into it.
But don't you dare...

- No, no, no, I won't cash that
check, I promise.

- Okay. Who made the arrest?

- Mac, let me do you a favor.

We've got a 911 call with both

Ron Garrison's and Bob Carter's
voices before the gunshot was
heard.

And we found a jacket at the
crime scene belonging to Bob
Carter.

And a pair of rubber gloves that
are getting tested for gunshot
residue.

- Sounds bad.

- There's more.

I have witnesses
at KTMB Radio

who heard Carter tell the
deceased to drop dead.

And a bartender who heard him
say that,

he was definitely going to set
the record straight,

a half hour before the murder.

- Well I promised one of
Carter's entertainment lawyers

that I would have a talk with
him.

- He was caught running from the
scene at the house.

You do not need this case.

- Thanks for the info.

- Off the record.

- Of course off the record.

Oh, listen, did you guys find
the murder weapon?
- No.

- You see, there's that little
silver lining I love so much.

- I, I, I couldn't be on that
tape, I wasn't there.

I was at a bar, venting my anger
to the bartender.

- A half hour before the 911
call.

And you were telling the
bartender that you were
definitely going to set

the record straight with Ron,
for good.

- I was just venting my anger.

What about the text message?

It'll prove that Ron asked me to
come and see him.

- No, not necessarily. The
prosecution could use it against
you.

They'll say that Ron invited you
to his house to try and iron out
your differences.

You got angry and killed him.

- No, no, that's not true,
that's not what happened.
[whoosh]

Hey, Ron, Ron, I'm here, I got
your message man, come on.

Ron, come on, open up. Ron.

- And I saw the TV on, so I
figured he couldn't hear me.

So I started checking around for
an open door.

- Yo, Ron. I'm here.

I got your little old text
message and Bobby came running.

Come on out.

Is this another one
of your sick jokes?

Blowing me off again, Ron?

Oh,

Oh no man.

- They found your jacket at
Ron's house.

- I wasn't wearing a jacket that
night.

- They caught you, Bob, fleeing
from the scene after Ron made
his 911 call.

- I was drinking,

I panicked.

[whoosh]

You ever seen someone shot?

- Did you see someone get shot,
Bob?

- Look, Mr. McBride, I'm not
going to make any excuses.

Ron and I personally, we didn't
get along, it was lousy.

Professionally we were a great
radio team.

On air we were the best of
friends.

- But Ron was just about to dump
you.

- That's true. Which didn't make
me like him any more.

Ron was a difficult dude, he
reveled in humiliating people.

It was his stock in trade, his
shtick.

If you had listened to our show,
you'd understand that.

I'll bet there are a thousand
listeners out there

who are just ecstatic that he's
dead.

- Do you own a gun, Bob?

- No.

- I'm going to have to listen to
some tapes of your shows.

- That'll be difficult.
- Why?

- Contractually Ron's the only
one who had access to our
archive of shows.

Our shows were recorded
digitally and stored on the
stations mainframe,

and only Ron had the password to
download them.

- That's why God invented
subpoenas.

- Now I may be a lot of things,

but I'm not a killer.

[ominous music]

- Okay, let's talk about the 911
tape.

- Okay.

- Now if you weren't at Ron's
house,

that means that somebody wanted
him dead enough

to imitate your voice
to implicate you in the murder.

What you got to do is try to
help me figure out who that was.

- Okay, how?

- Well, you and Ron were
partners for quite a while.

- A couple years in Nashville
and three years here in L.A.

- So do you know anybody that
had a big problem with him?
Somebody in his personal life?

- One ex-wife, long gone.

Good settlement, happily
remarried.

- Uh huh, coworkers, any
animosity there?

- From pretty much everyone at
KTMB.

Ed, definitely, you got Leslie,

maybe even Kyle and Danny.

- Who are they?

- You don't listen to talk radio
very much, do you?

anybody else that comes to mind
that might have had it in for
Ron.

couldn't settle down.

So he was whining, pacing all
night long.

- Maybe we'll do better tonight.

in Southern California are glued
to the Ron And Bob Show.

Almost all of them have their
radios tuned to KTMB for the
entire day.

Do you know how much advertising
revenue that generates for us?

- A lot?

- Mm, more than a lot.

- So what happens to the Ron And
Bob Show time slot now?

- Well I guess that's up to you,
McBride.

representing Bob.

believe that Bob would do such a

Ron.

and a total lack of respect for
our listeners,

delivered by two sophomoric
pranksters.

- You think you'd do better with
their time-slot?

With tales of conspiracy and the
paranormal?

Um, so you were the first to see
them in the morning.

Now the day that it happened,
did you notice...

- I, you didn't really know
those guys.

They came in when I was still on
the air,

and they went right into their
studio.

Never really spoke to one
another, no real reason to.

- Now which show followed them?

- A syndicated show is piped in
from 10 to two, followed by Ed.

News hour's at six, then Leslie
and Kyle.

- Ed, what, what kind of show do
you do?

- Talk radio. Money matters,
personal problems, you name it.

- And do you have a large
audience?

- Not as big as Ron and Bob's,

but if I had a captive drive
time audience,

I'd probably be bigger than Ron
and Bob.

- And all of us would do better
if we had the morning drive time
slot.

But I don't, and I still manage
to have a very large audience.

- Uh, what kind of show do you
do?

- I, uh, counsel listeners on
romance and relationships.

- So that leaves sports, and
Kyle, that's you from nine to
midnight?

- Right. I do just fine, despite
what anyone thinks or says.
I've got a loyal following.

- Following. If you can call a
bunch of couch potato,

wannabe jocks with the IQ of a
football a following.

- You'll have to excuse us, Mr.

we're still all a little out of
sorts since Ron's murder.

- Oh, that's it, huh? Sure. Oh,
understandable.

Well that's a very interesting
group of people

you have manning the airwaves

- We like to think so.

- And I would think that, uh,
morning drive time slot

will give somebody a chance to
make a name for themselves.

- You get the picture.

- You think so? So Bob tells me

uh, only Ron had access to tapes
of his show, is that right?

- Yeah, it was in Ron's
contract. Why do you ask?

- Just trying to figure out how
Bob's voice got on that 911 call

if he wasn't at Ron's house when
the call was made.

That maybe, I don't know,
somebody gold hold of the tapes,

edited the whole conversation
together.

- That's kind of reaching, isn't
it?

- Well, sometimes you have to
reach.

You also mentioned earlier that
you have every confidence

you'll be able to fill that
morning drive time slot,

what's going to happen tomorrow?

- Well for the next few days
I'll be filling in.
- Oh.

- That's how I got started in
the business, in Seattle,

then moved my way up through the
ranks.

- San Diego.

Where you eventually became
station manager,

until you were offered the gig
here.

- You must be a fan, I'm
flattered.

- I do my homework. So for a
time you're going to be doing
double duty,

station manager and prime time
radio jock, huh?

- Just for a week or so until I
can straighten out the rotation
with Leslie,

Kyle, Danny and Ed.

They'll take turns rotating on a
weekly basis

to see if one of them draws an
audience.

- But if none of it works out
with them

you can just relinquish your
duties as station manager

and stay on the air.

- Well why would I do that?

- I don't know.

911 police dispatch call

made by Garrison the night of

just before the fatal gunshot

realized that he wasn't going to

So I confided in Leslie about

stoop to blackmail,

I knew Leslie would confront
Ron,

and I was worried about what
might happen.

- Because of his vindictive
personality, you wanted to make

- She was fine.

The next day I told Leslie I
drove by Ron's,

but never stopped.

- Took a long drive,

went home and told my wife
everything.

But Ron could have wrecked
things for Leslie by going to
Paul

and threatening to expose his
affair with her to his wife,

'causing Paul to wind up
divorced and broke like Ed
Harding.

- And costing Leslie not only
her job, but her future in
radio.

So either one of them had a
reason to silence Ron.

Then of course, there's Kyle.

He owes Ron not only his career,
but a lot of money as well.

You must have found out that Ron
that was a big gambler

who lost a vast sum on a
game-winning touchdown pass

that Kyle dropped on purpose to
satisfy

some rather scary organized
crime guys.

- Why do you think Ron got Kyle
the job here?

He wants to make sure that Kyle
had enough income

to pay back Ron who had found a
way to expose Kyle

for the sports fraud that he is.

Then there's Ed. [laughs]

Man, did Ron mess up Ed's life
with that stupid prank phone
call.

It cost Ed not only his
marriage,

but just about every dime that
he makes in alimony.

I'd put all their names on the

see which one really killed Ron.

to help out nonprofit

- Police dispatch has testified
the 911 call,

which was placed by the
deceased,

Ron Garrison and traced to his
cell phone,

which was found at the crime

You were notified and went
straight to the scene, is that

- That's correct.

- What did you observe?

- Mr. Garrison was found lying
on the floor.

He was pronounced dead at the

- So the deceased might have
known his assailant, let him in.

house and the grounds?

because the real killer took it
with him

when he left the premises before
the police even arrived.

tape were both threatening and

which was the recording from the
911 dispatch,

we will see that the two sound
prints do not match.

The recorded 911 gunshot is not
from a nine millimeter pistol.

If, however, we insert the sound

that was used by Kyle Ward on
his program,

you will notice that the sound
print of the recorded 911
gunshot sound,

and the sound print that was
used by Kyle Ward on his
program,

they match perfectly.

The Defense recalls Kyle Ward to

- I was on the air at the time
of Ron's murder.

- No, your radio program was on
the air at the time of Ron's
murder. [whoosh]

But according to the program
log,

that night you had a 30 minute
interview

with Jason Taylor of the Miami
Dolphins.

The engineering log shows that
that was a

prerecorded phone interview you
had done at an earlier time and
date.

You started that interview, and
then you went to Ron Garrison's
house.

- You stole Bob's jacket from
the station.

And you were wearing two pairs
of surgical gloves,

one for the gunshot residue,

the other so you wouldn't leave
any fingerprints.

You sent a text message to Bob
Carter from Ron's cell phone

to get him to come to Ron's
house.

- Yo, anybody down there?

[muffled gunshot]

- You shot him with a silenced
weapon.

And then you just waited for
Bob's car to pull into the
driveway.

Then you made the 911 call.

And you played the edited PSA
that you had made of Bob and
Ron's voice,

and the gunshot.

You hid the jacket and gloves in
a closet.
[whoosh]

You slipped out the side door as
Mr. Carter came through the
back.

Now what do you have to say
about that, Mr. Ward?

- I should have done it years
ago.

I had to get Ron off my back.
