THUDDING, SCUFFLING

Marcus Calderwood

identified me before he died as the driver in the hit-and-run.

Why did you have such animosity towards him?

I attended a crash.

Car T-boned, went under a lorry.

Please, please, where's the ambulance?

Stay with me, Daniella.

I kept on telling her she was all right, but she wasn't.

She was only on that road because of them.

Stop Climate Genocide!

Who's that? Marcus's neighbour.

You and Justin became friends

after the dispute between you and Marcus?

Justin isn't the only police officer I have social interactions with.

Do you want to know who else visited his shooting club? Go on.

Chief Superintendent Whitley.

I have to have accurate information at my fingertips, Helen.

The insomnia's driving me a bit nuts.

HE YELLS

You get them to tide you over, and then you get back to Dr Nesbitt

and you talk this shit out, Dad.

The bride with her face cropped out, is me.

It was just an administrative thing,

so this guy could get an EU passport.

But if it ever came out, I could lose my job. Please, Mum...!

Yeah, you say you don't need me, while at the same time

threatening me with this rubbish!

Classic gaslighting. DOOR SLAMS

Fight Climate Genocide

will carry out further actions against climate criminals...

This is the big split Marcus was trying to prevent.

MUFFLED SCREAMS

This is the face of death. SPLASHING, SHE SCREAMS

This is the smell of death. SHE SCREAMS

It can't be Marcus's bike! Well, why not?

Got both pedals, look.

So, we will never know that the pedal we found in the ditch

belonged to Marcus's bike? Meaning no forensics of any use whatsoever!

On the plus side,

Sandra Vodanovic is making a witness statement.

If she gives a different version of events to yours,

then you're in real trouble, Justin.

LIGHTS CLUNK

CROWD SHOUTS I cannot go into the specifics

of the Justin Mitchell trial,

but what I can say is that it is imperative that any crime

is fully investigated

and all of those involved are brought to justice.

I believe the killing of Marcus Calderwood

was a political execution.

QUIET MURMURING

Murderer!

Climate scum, more like!

Bunch of vegan ponces, the lot of yer!

COMMOTION

Fight Climate Genocide!

You're supporting a killer!

SHOUTING AND CHANTING CONTINUES FAINTLY

CHANTING GETS LOUDER

Scott Harrison.

Dax Daniels.

Stalin Gonzalez.

Zheng Junmin.

Sally Ascherson.

Ladies and gentlemen of the jury,

this is a complex case with a number of witnesses

and it may last a little longer than other trials.

All that matters in making your decision

is what you hear in this court.

Both the writing and reading of anonymous blogs

that break reporting restrictions is contempt of court.

Doing so could lead to very serious consequences,

including a prison sentence.

We shall now hear from Mr Holmes KC, for the Prosecution,

then we will hear from Ms Westwood KC, for the Defence.

The defendant, Mr Justin Mitchell,

using foresight, planning,

and considerable malice,

pursued Marcus Calderwood

and struck him from his bike.

The Prosecution does not have a shred of physical evidence

linking the defendant to the collision.

No DNA, no paint from the vehicle. Nothing.

Mr Calderwood named his attacker.

"It was a policeman called Justin Mitchell."

The naming of Justin Mitchell is open to serious doubt

given the particular and extreme circumstances

in which it was given.

Justin Mitchell then removed and disposed of evidence

using his partner, a Ms Sandra Vodanovic.

This witness is motivated by factors other than the truth.

Ms Vodanovic has every reason to provide an account

which favours the Prosecution

and damns her partner.

One of the jurors has got purple hair and a nose ring.

Did you see that? I did. How did she wriggle through?

We don't get to chuck people

off juries for their appearances, fortunately. Oh...

How about names?

Stalin Gonzalez!

It's not uncommon in Latin America

for children to be given names from history.

Also, Stalin wasn't entirely anti-police.

Win-predictor flickered a bit.

What's the running order?

Grace Eze, the paramedic,

and I guess they might try and squeeze PC Taylor in.

Oh, I'd squeeze him in all right, the miserable little turncoat...

..to a matchbox, straight after running him through a car crusher.

Yeah, well, I think we've spoken before

about expressing violent fantasies.

Oh, everybody has violent fantasies, Sam. It's normal.

Taking out that wanker on the radio for a start.

I won't ask. Best not.

Fantasies.

FANTASIES!

That means they're not real.

Although, I'm not going to lie,

given a nice secluded spot, a hefty baseball bat...

Whoa, look, is that the time? We best, um...

Fat bald geezer at the end of the row -

has to be a cabbie, so that's a win.

Shall we?

Sorry.

DOOR BUZZER

DOOR SLAMS

CHANTING AND DRUMMING FROM OUTSIDE

Justice for Marcus! Justice for Marcus!

CHANTING CONTINUES, AIR HORNS BLARE

There were lively exchanges this afternoon

in the trial of Justin Mitchell.

The Prosecution's first witness

was the paramedic from the scene, Ms Grace Eze.

And when you spoke to him, what did he say?

He said to me that the driver of the vehicle

was a policeman called Justin Mitchell.

And what did you do with that information?

I told a police officer at the scene.

Justin Mitchell's Defence team, meanwhile,

questioned the validity of this identification.

Would you say that Mr Calderwood was in a lot of pain?

Yes, I would.

Had you administered pain relief?

He was given 20mg of morphine sulphate.

So, just to be clear,

it was... It was very noisy, stressful...

There was a lot of adjacent activity,

people in police uniform.

The victim had spent all night in a ditch,

was in extreme pain, and had been given a powerful opiate?

But the question that will generate the most controversy

is why the police did not act immediately

on the information given to them by the paramedics on the scene.

I completely panicked.

I mean, it was such a shock.

So, I phoned PC Kyle Jones and said, "What shall we do?"

He said he'd deal with it.

Did you throw PC Jones under the bus to protect yourself? No.

You left him to "deal with it" for over 24 hours,

knowing that every minute might be precious.

Everything you're now telling us is just another attempt

to stay out of prison, isn't it?

I wish I'd acted in a different way.

East Sussex Police can expect to receive a lot...

Online poll says that 82% of people think he's guilty as fuck.

As opposed to mildly guilty?

Who ran this poll, Yanis Varoufakis?

Uh-oh, theme-warming in process. I know, I know.

I know, I know a rigorous sampling frame

is a horribly Western concept... And we're off!

..Mani, but luckily, a jury is drawn from a cross-section of society

rather than a bunch of Zoomers fighting fascism

from the front line of their keyboards.

Speaking of fascism, have you seen that group Legitimate Defence

attacking people outside court?

They're your preferred "sampling frame", then?

Well, I hope you don't do ket, Mani.

OK, who ordered the non sequitur?

It will play merry hell with your urinary tract,

and you'll be in a nappy by the age of 30.

I can see what you're doing. What?

But Juzzer is going down.

Whoo...!

Your client's going to prison cos he's a piece of shit!

..Contempt of court,

they will not be making any further statements

about the conduct of their officers until the conclusion of the case.

Senior management are denying there's any evidence

Patrick Norris was an informant.

They would.

My investigation's a work in progress

but I have a few good leads. Where did the information come from?

I don't reveal sources, you'll be pleased to hear,

but I need you to find out more about the Crawley drugs trial

and why he escaped prosecution there, as well. Felix...

That one's a bit out of my league, I'm afraid.

He's protected and he always has been.

We need to tread carefully with the blog.

Your piece about Justin as Norris's useful idiot

is clear contempt of court.

What are they going to do, prosecute the internet?

Yeah, even so.

But one thing I do know is that Whitley knew Justin had issues.

He'd been reported by colleagues and he did nothing. What for?

Excessive speed while driving. Inappropriate language.

Is that useful to us?

I don't know. Is it?

Look, I'm not especially interested in the firing squad.

I'm interested in the person

that gave the order to shoot...OR people.

And I'm interested in the culture that Whitley is overseeing.

Look, it's not just about replacing an unpopular boss.

It's not just about quadrupling your subscribers

with a sexy story about the evils of Big Oil.

Get me more on Norris's ties to the police...

..and I'll do a job on your Chief Superintendent.

There is an increased police presence

outside Brighton Crown Court,

as the trial of Justin Mitchell enters its second day.

The court finds itself at the centre of demonstrations

by Stop Climate Genocide splinter group Fight Climate Genocide,

and the right-wing protest group Legitimate Defence.

CALDERWOOD, And you're on camera by the way, Officer.

MITCHELL, Oh, good.

Then there's record of my concern for your welfare,

as well as other road-users.

I'd hate for a car to just smash into you one day.

Leave you slowly dying by the side of the road.

So, this is the culmination

of a significant history of contact

between Mr Calderwood and the defendant, Detective Inspector? Yes.

And how does it end?

With Mr Calderwood telling a paramedic

that PC Justin Mitchell drove into him.

Now, we've heard from PC Taylor

that he failed to act on this tip-off.

What happened during the regrettable delay

to your investigation that this caused?

Sandra Vodanovic took the suspect's car overseas.

She carried out significant repairs, including a respray.

Can I just ask you about mobile phones?

Do you have anything placing Mr Mitchell

at the scene of the collision?

No.

How does he explain that?

He'd left it at home.

Was that common?

No, he usually tracked his exercise on a running app.

As a serving police officer, yourself, would you say that

mobile phone evidence is important in solving a crime?

Yes.

And would you have expected the defendant to have been

equally aware of that? All police officers are aware of it.

So, as Mr Holmes most helpfully established for the jury,

no mobile or dashcam evidence?

No.

Well, strategic owning up doesn't diminish its importance

and it bears repeating.

No mobile or dashcam evidence.

So, let's turn to forensics,

which I'm sure you would've hoped would help fill that gap.

Would you agree that evidence from the vehicles involved

is like gold dust in cases of road collisions?

I would, yes.

Yeah, and you were brought in from another force to help find

that gold dust? Well, I was originally brought in

because of the nature of the investigation... Yes, yes.

..and the possible involvement of a serving officer...

The bicycle belonging to Marcus Calderwood, where was it found?

In a pond on the grounds of Danver House.

There is a shooting club on the grounds, is there not? Correct.

Did you interview any of the members of that shooting club?

Yes.

But you ruled them out.

Yes. Ah.

Well, did you know the defendant was having a sexual relationship

with the wife of one of the members of that shooting club?

MURMURING

It transpired during our inquiries.

Yeah, but you...

You didn't consider that relevant?

No, cos it isn't.

Oh, yeah, I wonder if you could help me with something, DI Southgate?

How many pedals are there on an ordinary bicycle?

I guess I must be important if you're not in court.

Miles Southgate is giving evidence this morning,

and after how it went with PC Taylor,

I suspect he's in for a bumpy ride.

He'll do better than him, though.

You should have seen Nicky at the Christmas pub quiz,

he thought that, um...

..a penguin was a fish

and that the Andes were in China.

Wa-a-ait... Penguins AREN'T fish? BECKY LAUGHS

Southgate will be OK, though..

He's straight as a die that one.

The thing is, our case is based pretty much entirely

on circumstantial evidence.

Very strong circumstantial evidence,

but you know what juries are like.

Well, not any more, thank God.

We really need you to show up for us, Becky.

You know all about the D4 stuff,

what Justin was like in the build-up to the murder, the complaints you...

I didn't make complaints, I raised concerns. Fine.

But we do need a statement of all the stuff you told Miles.

I'm getting back on my feet...

You did the right thing with the D4 transcripts.

And they drove you out for it.

Make it worth it.

So, let me see if I can summarise your evidence,

DI Southgate, as I suspect the jury may be as bewildered as I am.

What you do or do not suspect, Mr Malik, is of no relevance,

as you well know. Sorry.

So, you find a pedal, you test the pedal,

and think you found evidence of a collision with Mr Mitchell's car?

Yes.

Found some black paint and you think, "Gotcha!"

Obviously, we thought it was significant.

But then, you make a mess over the colour of the vehicle...

It was a communications issue with the manufacturer...

Yeah, sure, sure, and then, the results came back...

..inconclusive.

It was compromised by the time spent submerged in the ditch.

Er, but we were hopeful of obtaining a new sample.

Oh, yes, yes, if only the bad news ends there, DI Southgate,

but it gets worse, doesn't it?

Because then, you find a bicycle with both pedals attached

in the decoy pond of the shooting club?

And then, faced with this conundrum,

because as we've established,

three pedals would be considered somewhat unusual on a bicycle...

SCATTERED CHUCKLES

..you go back...in desperation...to the first pedal.

Only to find...

Only to find, DI Southgate...

Hey, you lost it.

No mobile evidence.

No dashcam footage.

No forensic evidence of any value whatsoever.

I mean, this whole investigation is about as roadworthy

as a three-pedalled bicycle, is it not, DI Southgate?

QUIET LAUGHTER Mr Malik!

Sorry. I'm so sorry. Sorry.

Is that an accurate summary, DI Southgate?

It's a very selective summary.

Oh, really. Is there a further piece of incompetence I overlooked?

Hmm?

No further questions.

The police came under serious pressure today

when it transpired that a potentially significant piece

of evidence had been lost during the investigation

into the death of Marcus Calderwood.

This comes after yesterday's evidence that members

of his force had given warnings to the accused...

Tamara's been a bit quiet.

Yeah, that's what's worrying me.

Don't look. Look? Don't look? I don't know which is worse.

Looking. Then you just imagine.

MOBILE VIBRATES

Shit, it's Mum.

Well, answer it, then.

Hello?

Mum?

Hello?

OK, I'm coming, I'm coming.

Have you called...?

OK, just try and stay calm, OK?

I'm coming.

She's sick and it's been 45 minutes

since she called the bloody ambulance. I'm going round there.

A good evening to you, too.

Seen this?

It's pretty tricky without, you know...

That anonymous blog Indifference Kills...

AKA, Felix Owusu, who'd better watch his arse.

..he's done a hatchet job on that Whitley bloke. Oh.

How many "toxics" in the sweet jar?

Quite a few, yeah.

And some "systemics" you won't like. No "genocides".

Ah, small mercies.

He's asking why the Feds ignored concerns about serving officers.

Oh, Mani, please, don't say the word "Feds" - even ironically.

The top brass all knew about it,

as well as protecting this geezer.

"Patrick Norris was closely linked

"to a group of businessmen from Crawley.

"Four of whom were prosecuted for importing drugs from Latin America.

"Norris himself, curiously. avoided prosecution again,

"forcing us to ask why..." DOOR BELL RINGS

Get that.

Why don't you get it?

Because I'm sick and tired of working all day to earn money

that pays for this, this... OK.

..this, this, this... OK, all right.

Move! DOOR BELL RINGS

Let's hope it's not the Feds looking for Roger Blumenthal. Go!

Hello. Hey, how are you?

Good, thanks. It's Claudia!

Well, send her through!

I am sending her through!

HE SIGHS

New card, opens upstairs and down.

The camera's are also installed,

you just need to download the app.

Are you going to be all right in the office by yourself?

Well, I'll have to be.

I'm not getting driven out by those entitled little fascists.

Good.

Right, it's zesty with a decent weight,

but more importantly, it cost £5.49.

Oh! It sounds like you had a fun day in the office!

Yeah, it was tough on DI Southgate, cos, obviously,

none of it was actually his fault. Well, that's life.

GLASSES CLINK

I think Justin did experience PTSD.

He also insists that he didn't do it,

so none of that helps us. POURS WINE

True, but the way he keeps referring to the traffic accident

is confirmation for me.

He repeatedly sought Marcus out.

PTSD usually involves avoidance.

I mean, you know that.

You hate going near train stations, remember?

It can be complex.

You charge at the things that you want to eliminate or avoid.

Well, if I'm sceptical,

think how the jury would have been.

Especially if he ever had to give evidence.

Ah, it's... It's masking,

and he's brilliant at it.

You know, you can use your mind against your condition,

we're not entirely defenceless.

So, how's it going in the sleep department? Oh...

Built up a tolerance for these pills.

That's not a quality I massively associate with you!

SHE CHUCKLES

If these drugs don't work, I don't know what else to do.

Err, just...

..go back to your therapist, Sam.

Use your mind against it, remember?

My mind's my own worst enemy at night.

Right, I'm going down the pub with Rachel and Bex. OK.

We might go on to a party after,

so my phone is on airplane mode, so you do not stalk me.

Oh, very good. Yes, it's just... It's just that I worry.

And if anybody starts on you, you just tell 'em who your dad is.

Get them to feel sorry for me, great strategy.

CLAUDIA CHUCKLES Keep an eye on him.

He really is such a lovely boy, though, isn't he?

Yeah.

So like Nor.

He's like you, too.

DOOR SHUTS

Alex.

Hi.

Yeah, they're saying it might be a pulmonary embolism.

I'm going to stay here until they...

I'll speak to you later.

So, I've seen the doctor and he said that...

Excuse me.

Um, I'm here about my mother. This is absurd.

How old are you, for fuck's sake?

I've already spoken to the doctor. This is my half-sister,

who I cannot have any contact with, due to the present

and ongoing danger she represents to my safety and mental wellbeing.

Oh, my God...! Please could I speak to a member of the medical staff

who's caring for Dame Harriet Kenny.

Hold on.

Tam, for God's sake!

MALIK GROANS

HE SIGHS

HE TAKES A DEEP BREATH

PROTESTERS SHOUT INDISTINCTLY

CHATTERING

Gee, Leila, you look like I feel.

I was at the hospital. My mum's been taken sick.

Oh.

Well, I'm sorry to hear that.

Is she OK?

I was there all night with my sister, who won't say a word to me.

Why not?

Because I'm a blockage that she needs to remove

in order to realise her full self.

Wow, that sounds like shit therapy to me.

It's like she went in and said,

"Help me out. I'm a mad selfish arsehole," and somebody's said,

"It's cool to be a mad selfish arsehole, because that's

"affirming the real you. Carry on being a mad selfish arsehole."

"In fact, be more of one, assert yourself,

"that'll be 200 quid, please." Oh!

Hey.

Sorry to hear about your mum.

You despise my mum.

Doesn't mean I wish suffering on her!

Not physical, anyway. She's very influential.

Yeah, that's quite the tribute. Oh, it's the best I can do.

Come on, pull yourself together.

Round two.

I still cannot believe Grainne took this case.

Yeah, we go way back.

I used to be a massive lefty back in the day.

Shut the fuck up!

So, what happened to Good Sam?

Oh, he grew the fuck up.

Still a little bit of him in there, though.

Gee, Sam, you're just so admirably complex.

Oh, hey, whoa! I've got my son for that. Come on.

Come on.

SHE SCOFFS

Eh?

Come on.

I'd say we're maybe just under par at this stage,

which is fine because we've still got our best witnesses to come.

Thanks.

You did OK in the circumstances.

Better than Taylor.

Wow, can't believe I cleared a bar that high.

The whole truth, and nothing but the motherfucking truth.

Hi, Becky, this is Philip Holmes KC.

Where's the rest of the Sunshine Band?

Thought Leila'd be here.

Oh, right, er, no, Leila's mum was been taken ill, unfortunately, so...

Oh. Sorry to hear that, um...

Yeah, send her my best.

OK, so the critical thing in your evidence

will be Justin's attitude to Marcus.

We'll kick off with what you knew about the giraffe nickname.

Sure, but just one thing there.

I'll answer questions about Justin,

but don't try and get me dish dirt on anyone else.

This isn't about...

You know, I'm not here to fill the papers

with more rubbish about the police.

Those people weren't "a cancer", they were my mates.

And most of them were really brave and faced a lot of dangerous shit

in their work, which no journalist will ever have to put up with.

Of course. Understood.

Oh, hi.

Oh, hi, Leila.

Sorry to hear about your mum.

You OK, is everything...?

I'm fine, thanks. Mum's stable.

Just don't ask me any complicated shit,

like what type of animal a penguin is.

It's a bird.

Shut the fuck up. A bird? It swims underwater!

Yeah, what's wrong with you? It's definitely a fish!

You going to be OK?

Make it worth it.

I'll try.

So, Ms Hollis, you are no longer serving with the police?

Correct.

What is your current profession?

You mean, apart from slave to a couple of lazy daughters?

Um, I also help out at my sister's salon.

Big change.

Why did you leave?

I was tired. I'd been doing it a long time,

and I needed a change. OK.

Now, we've heard evidence about a group chat with the name D4.

You are familiar with it? Yes.

I was a member of the group. An active member?

No, no. I...I read it mainly.

Some of it was pretty funny. Some of it less so.

Which bits weren't funny?

Well, some of the bad stuff was also funny,

cos let's be honest,

sometimes, bad stuff is.

Um, people don't understand, always too busy getting offended.

But, um, yeah, some of it was bad and not funny.

I'm going to refer the jury to the item in their bundle marked...

..2C, if I may?

Who is "Kenny"?

That's Justin.

Now, he excuses himself from an outing planned by the group

on the day when, on the Crown's case, the murder occurred.

Were you surprised by that?

Yeah, very. Um, it was the races.

Justin would bet on train delays.

The giraffe and hunter emoji.

What did you understand by that?

Er, the giraffe was a nickname he often used for Marcus Calderwood.

When he put the giraffe emoji,

were you in any doubt what it referred to?

No, I thought it was Marcus. We all did.

What did you understand by it?

Well, that he wanted to yank his chain,

which he liked to do now and again.

Did you ever raise any concerns about Mr Mitchell?

Yes. For...?

Dangerous driving and some of the things that he said.

Can you give me an example of some of the things he said?

Well, he once said to me that,

if he was ever going to murder somebody,

he would choose hit-and-run.

MURMURING

He might have been joking.

Did you think it was just a joke?

Well, that was the thing with Justin. You never really knew.

Would you agree that hit-and-runs are very difficult cases? Yes.

And that Mr Mitchell's comment was not made

during a conversation about Marcus Calderwood? No.

Did Mr Mitchell ever express his desire

to kill Marcus Calderwood? No.

OK.

Now, can we just go back to the transcripts for a second, Ms Hollis.

Er, the person who expresses incredulity at Mr Mitchell

for not going to the races,

using the handle "Sniffer".

PC Kyle Jones.

That's right.

Just to remind the jury, this is the same officer

who PC Taylor has admitted to calling from the scene.

How did he get that nickname? Oh, always first to the knicker drawer

during a property search.

CHUCKLING Mr Mitchell teased him a lot.

Justin teased everybody a lot.

Was it only an interest in suspicious lingerie

that earned him this nickname?

No, he was also known for sniffing around a particular

part of management anatomy.

Yes, indeed.

Mr Mitchell refers to this tendency on other occasions.

He makes several jokes about his long dark tongue, does he not?

I don't remember so well.

Don't giraffes have long dark tongues?

Don't know. Ask David Attenborough.

LAUGHTER

Well, we will return to this later.

You've raised concerns

over Mr Mitchell's use of inappropriate language.

Yeah. But you're a member of D4.

You've seen stuff that's misogynistic, racist, homophobic,

did you raise concerns over that?

No.

Why not?

It was different. Oh, I see.

"The best way to murder somebody would be a hit-and-run."

Are you seriously telling me that's the worst thing

you've ever heard as a serving police officer?

People say stuff like that all the time in your profession, don't they?

Not all the time, no.

Isn't it just the semi-serious musings of someone for whom

crime is part of their everyday? No.

It was hard for me to raise it,

because I like Justin.

But it was important enough for me to take it to a senior officer.

What was the outcome?

Nothing, to the best of my knowledge.

Mr Mitchell ever refer to it?

He said someone had grassed him up.

But he didn't know it was you?

Hmm. I wasn't the only one.

And, err, no, he didn't think it was me.

Er, he made a joke about it. Um, he said it would all be fine

because Chief Superintendent Whitley was a Belieber.

A what?

Well, he's called Justin, as in...

He meant that Chief Superintendent Whitley was a fan of his?

Yeah, a superfan.

That's a shame.

I actually liked Becky. I never had her down as a grass.

This stuff's also been picked up by the blog Indifference Kills.

Contempt of court. It's an anonymous blog,

so hopefully the jury will listen to the judge's warnings about them.

Becky wasn't the only one to show concerns about you.

Yeah, but what happened? Nothing.

Did nobody else speak to you about it?

Oh, yeah, I mean, they tried to make me go and talk to somebody.

Somebody?

Yeah, you know...

"You see a turtle on its back in the baking sun" kind of shit.

And? And I didn't go.

Why? We've been here before.

I didn't need it. But what made THEM think that you did?

I mean, probably Daniella Fielding.

But this isn't news, Sam.

No, no, no, missed psychiatric appointments, Justin,

is very much news, actually.

So, you didn't go.

How many times didn't you go?

Errrrrrrr... Two.

Maybe three. And nobody else followed up on it?

What does it matter? Well...!

I've instructed you on my defence and it isn't the mental health card.

All right, yeah, yeah, yeah. Not the mental health card.

Brilliant! There's nothing wrong with my head. Oh, fucking hell!

There never has been. Yeah, yeah.

Don't project Sam's weakness onto Justin.

It's not weakness.

Yeah, it is.

Justin... You can't sleep.

Why can't you sleep? Because you're weak.

No, it's because I keep....

..imagining my wife being sliced in half after...

..after jumping in front of a train.

So, stop fucking imagining it, then.

HE LAUGHS

Stop imagining it? Yeah.

Oh. And what do you suggest, as a distraction, Justin, eh?

Sordid sex with other men's wives?

Well, I wouldn't knock it, mate. No, no, no, fantasising...

..fantasising about beating people?

Hmm?!

Gaming my own freedom on a murder trial?!

I do hope you're not making light of addiction,

especially in today's cultural climate... Oh, fuck off, Justin!

Fuck off, you stupid, facetious little prick!

DOOR BUZZER Everything OK?

All right?

Can you believe he just called me a "stupid, facetious little prick"?

I'm surprised he called you it.

Cheeky Girls reunion, is it?

Sorry, from the very beginning,

you've treated this like one big joke,

and that includes your dealings with me.

Right, look...

I'm sorry.

All right?

I apologise.

HE LAUGHS

We always hurt the ones we love.

Yeah, but most people,

most people do it inadvertently, don't they, Justin?

And they feel...

..they feel regret.

You wanted to see me, Miles? Hmm.

Come in.

Apologies.

BOTH CLEAR THEIR THROATS

I think you should resign.

Becky Hollis told you about Justin and you did nothing.

You saw footage of Justin threatening Marcus

and you did nothing.

You had opportunities to prevent this tragedy, but you didn't.

You sanctimonious little prick.

And I suspect, although I can't prove it - yet -

you also had a relationship with Patrick Norris

that went beyond what is professionally appropriate.

You need to be really careful, right now.

There are some toes you do not want to tread on.

Threat noted...and ignored.

Well, we'll see.

You know,

I was publicly humiliated in court

because of the incompetence of others.

I did not like the experience.

So, I'm giving you the opportunity to avoid it.

Resign.

Or I will take you out.

PROTESTERS CHANT IN DISTANCE

Sam! Sam!

No, no, Sandra, I can't talk to you.

I could be struck off.. I know that.

..or worse, face a charge for interfering with a witness.

Please read this. What is it?

I have to tell the truth. Of course, you should tell the truth!

The truth is hard, though.

It is complicated.

It isn't always one thing or another.

But courts are one thing or another. There's no middle ground.

I want you to know. Know what?

What it was like, living with Justin

after the thing with the pregnant lady.

Why are you giving it to me

Because you are a good man.

And because I think you'll understand.

This is not whether Justin did it or not.

I know that he...

Don't! Don't! Don't!

I know that he has much pain.

And some of this pain he gave to me.

This is not about guilty or not guilty,

this is about the truth.

You OK?

Yeah.

What's up?

Oh, you know, just...

What are you doing?

Get off.

Life and shit.

Oh, life and shit.

Fair enough.

Internet's going wild about giraffes and panties.

Their word not mine. Hmm.

It's probably due a revival.

They're memeing the giraffe.

"Memeing the giraffe"?

Yeah.

HE SIGHS

Like that stupid frog.

Bliss it was in that dawn to be alive.

Sandra wrote me a letter.

She told me some things. Things you didn't tell me.

Maybe they weren't relevant. Nothing to do with the case.

I think they've got a lot to do with the case, actually. Such as?

It will come out in Grainne's cross-examination.

Such as?

The problem is in trying to help you,

she's handed us a gun to shoot her.

Don't get fucking cryptic on me, Sam, just tell me.

Well, we're going to take all

the terrible things that you did to her...

..and use them to kill her in court.

No room for weakness, Justin.

It's our only hope.

Yeah!

DOOR BUZZER

Why did you take the car to Serbia, Ms Vodanovic?

To collect a dog.

But why did you leave so suddenly that day?

I was meant to go on Thursday,

but then Justin told me I had to leave immediately.

When you took the car to be repaired,

did you think it was for the damage from your gym accident?

No. The damage was different?

Yes. I...I lied about that.

Why did you go along with it in the first place?

Justin told me it was something to do with insurance.

Did you believe him? Yes.

How would you describe Mr Mitchell's tone

when he was talking about getting the car repaired?

He was...

Ah...

I don't know, he...

..he seemed kind of excited?

Did anyone visit your house that morning?

PC Jones,

he is not a good person.

Why do you say that?

He got drunk at a barbecue and told me he wanted to have sex with me.

Did you tell Mr Mitchell that?

Yes. And...?

He just laughed.

So, to be completely clear,

the damage to the car was different

from that caused by your gym accident?

Yes, it was totally different.

And Mr Mitchell instructed you to bring forward Poncho's collection,

take the car to Slovenia and have an entire body panel replaced?

Yes. It's Pancho, by the way.

Oh, I do beg your pardon.

Do you know what PC Jones said to Mr Mitchell when he visited?

I don't know what was said between them,

but Justin changed completely after that visit.

In what way?

He told me I had to hurry up and get out of there.

He...practically pushed me into the car.

No further questions.

Now, Ms Vodanovic, you've admitted to assisting Mr Mitchell

to dispose of crucial evidence,

albeit without knowing the reason. Yes.

Had Mr Mitchell ever expressed his intention to harm Marcus Calderwood?

He-He hated him.

Did he tell you, that he thought he might drive him

off the road?

Use a hit-and-run to kill him? No. OK.

Did you know that Mr Mitchell was friendly

with a man called Patrick Norris?

Yes. Did Mr Mitchell ever go to the shooting range

at Danver House, with Mr Norris?

Maybe. He... He used to go out and not always tell me where.

Just as he didn't tell you that he was having sex

with Elena Norris, episodes that we now know were being filmed

by her husband and uploaded onto a porn site?

No, he didn't tell me that.

But you know that now.

Yes, I know that now. How did you discover that?

The police told me.

When you were being questioned under caution for assisting an offender?

Yes.

Did the police tell you anything else in that interview?

Like what?

Like how they knew that you performed cleaning duties

without your clothing, for wealthy men.

WHISPERING

Not often.

And that this was done to clear Mr Mitchell's gambling debts. Yes.

So, when the police told you that Mr Mitchell was sleeping

with his friend's wife,

and belittling your sacrifice,

you must have been angry.

Yes, but I'm still telling the truth.

You must have wanted to get your own back.

Maybe, yes, a bit, but it is all true.

Did you hate him for it?

I didn't hate him.

I-I loved him.

I always did and I still do.

He has a very sweet and gentle side to him, as well.

As well as what?

The traffic accident changed him.

He...

He stopped being sweet and gentle, mostly.

He was always gambling.

Crazy bets.

Sometimes, he would not come home.

And I tried to make us a nice home.

I tried to make him happy.

I...I put flowers in the hallway.

I-I made him food that he liked.

Scented candles to make the house smell nice.

I wanted him...

..I wanted us to have a family together.

You wanted to have a family?

Yes.

Could you speak up a little, please?

Yes.

And how did Mr Mitchell feel about that?

Did you become pregnant by Mr Mitchell, Ms Vodanovic?

Yes.

And how did Mr Mitchell respond to the news?

Not so well.

I must ask you again to please speak up, Ms Vodanovic.

I lost it.

I lost my baby, OK.

And how did Mr Mitchell respond to that?

He was...

He was cruel.

He said it was better this way.

It's not the first time he's been cruel to you, is it?

SHE SIGHS

No.

And was all this enough to make you want to punish him?

I didn't want to punish him.

I...

I wanted him to be happy again.

Nevertheless, Ms Vodanovic,

I put it to you that you have ample reason to...

NO! There is no nevertheless! Leave her alone! Mr Mitchell...

No more questions! Leave her alone! Leave her alone!

..I must ask you to refrain from such outbursts

or I'll have no alternative other than to pause the trial.

She's telling the truth! I treated her like shit! Like shit!

Mr Mitchell, I must insist... And all she was doing

was trying to make a nice house and a nice life for the both of us!

I must insist on no further interruptions. I'm truly sorry.

I'm truly sorry. You deserve far better than me.

My Lord, I request a little time to talk with my client.

I think that would be very wise.

Given the time now, I am going to adjourn until tomorrow morning.

Please impress upon your client the need to respect this court

or I will have no alternative

other than to conduct the trial in his absence.

Of course, My Lord.

DOOR BUZZER

We cannot suggest to the court

that she is not telling the truth,

when you have just said that she is.

I know.

And when you say she was telling the truth... Everything was true.

Then do you have an alternative explanation as to why

you told her to take the car to Slovenia?

Oh...!

Then my position is completely impossible.

Can I speak to Sam alone for a bit, please?

That might be a good idea.

Remember, we cannot unhear anything.

And we cannot knowingly mislead the court.

DOOR BUZZER

DOOR CLOSES

When did she lose the baby, Justin?

Don't go there.

Did you see a parallel...? Don't fucking go there!

I swear to God, Sam, do not fucking go there!

Your fucking psychobabble.

Yeah, we were going to call her Pearl if it was a girl.

Were we, fuck.

Did it remind me of Daniella in the car?

Did it trigger me?

Did it, Justin? Justin, did it? I didn't need reminding, Sam.

I couldn't ever get that out of my head.

That horrible metal,

I could see it jabbing in her intestine.

That arsehole saying don't grieve for her,

I'll grieve for who the fuck I want, you preachy, preachy little cunt!

All right, shh...

Calm, calm. Yeah, I'm calm.

All right. I'm calm. Fine.

All right. All right...

All right.

I did it.

I ran Marcus Calderwood off the road.

But you know that,

you've always known.

You don't know the whole story, though.

Well, that doesn't, er...

..matter so much right now as, er...

As Grainne said, we can't knowingly mislead the court.

So, it ends here, then.

Well, there's one remaining option.

I ask the judge for you to be rearraigned

and you plead guilty to the manslaughter charge

on the indictment by reasons... Yeah, I'm not doing it.

There's a tiny chance,

given that the police didn't respond properly to concerns about you,

and we can use Sandra to our benefit now.

She might be the key to all this.

Look, I don't believe that you losing your baby

had no impact on you, given the circumstances.

And Sandra's testimony clearly shows evidence

of mental disturbance.

The Prosecution will refuse to accept the plea

and argue premeditation.... No shit.

A cop playing the mental health card last minute? No chance.

There's a whole world out there that need a head on a plate.

The odds are against us for sure, but it helps.

Justin, it helps, that I do believe it.

Oh...

I've believed it from the start. Oh, Sam.

Thank you, mate.

HE SIGHS

Then you're just as bad as all the rest, Sam.

Fucking cry-babies, weaklings, and attention-seekers.

If everybody's nuts, then nobody's guilty.

There's no crime any more.

No free will, just excuses, and they can't have that.

There'd be no prisons, would there? There'd just be therapy dogs.

I did it. I did it.

HE BREATHES DEEPLY

Because I hated him so much.

I hated him, Sam.

Because he killed a woman and her unborn baby,

and nobody will ever convince me otherwise.

And now, I never have to see his smug face on my TV again,

telling us who we're allowed to grieve for.

I'll have to take what's coming, then.

No, there'll still be stuff coming, Justin.

You're pleading guilty, remember?

Just to manslaughter instead of murder,

where the sentencing start point is seven years,

as opposed to a mandatory life sentence.

Now, a win predictor of 20% is worth it, eh?

One in five.

What is it? It's a letter, written by Sandra.

I didn't want to show it to you before her testimony.

Maybe this will help you understand how other people see you...

..rather than how you prefer to see yourself.
