Every so often, homicide detectives

get a tragic case where a victim is killed

simply because they're in the wrong place

at the wrong time.

- A peacemaker ends up in the crossfire.

- That's even worse than being an innocent bystander.

- Then...

- He was facing whoever shot him.

- A young man killed

after a night out with friends.

[sobs]

- one car shoots into the other car.

- And a woman pays the ultimate price

for her boyfriend.

♪ ♪

[dramatic music]

this first case in memphis stands out in my memory

because the victim was simply trying to do a good deed,

and he wound up dead because of it.

[soft dramatic music]

narrator: An ambulance transports the man

to the hospital where he's pronounced dead.

♪ ♪

- lieutenant, can you give me the basic story

about what happened? - We got a miss.

I mean, you got quite a big crime scene.

♪ ♪

this is one of the busiest streets in memphis.

♪ ♪

luckily, nobody else got shot.

♪ ♪

- here's a little blood right here.

♪ ♪

so you can see the rain's kind of starting

to wash it away a little bit.

♪ ♪

here's his glasses right here.

♪ ♪

we had four or five shots.

Now, we only can find one casing.

These casings could be blowing all over the place.

[indistinct chatter]

- 81-01. - Right.

Narrator: From the hospital, detectives learn

that the victim is 32-year-old alfred henderson,

nicknamed scooter.

He was the head chef at the memphis marriot.

- a witness over here just got through telling me

this is actually the victim's car right here.

Narrator: Oliver examines scooter's car.

- There's a bullet right there in the back

of that back windshield.

♪ ♪

we're going to tow this car.

♪ ♪

narrator: Oliver canvasses bystanders.

They give him a key lead.

The shots were fired from a gray chevrolet caprice.

- What we can gather right now; some guys roll up

and started shooting, everybody started running.

It was just now getting calm enough

to where we can kind of talk to some people.

Narrator: Investigators take more than a dozen bystanders

downtown for questioning.

- bunch of folks up here.

We got folks in every bureau working.

♪ ♪

- have you ever seen the guy that shot scooter before?

Narrator: Then...

- One dude walked over there, and he swung at me,

so we got to fighting. - Ok.

Narrator: A man named delaney hanes

says that he had an argument

with the shooter minutes before the murder.

narrator: Delaney says that the man and some friends

drove off in a gray chevy caprice.

They returned minutes later with a gun.

♪ ♪

- the guy who got killed was trying to make peace.

That's even worse than being an innocent bystander.

Narrator: Delaney believes

the shots were intended for him

but hit scooter instead.

- And he rolled down the window, pulled gun out

and started shooting. - Was he driving or riding?

- He was in the backseat.

- What do they call this guy on the street?

- I don't know him. I don't be around that.

- Do you know any other guys in the car?

Narrator: An eyewitness has spotted the gray chevy

parked at a house near the crime scene.

- Hold on just a second.

They're bringing him down to the office,

driving down pearce--

hey, that's the house they live at.

There's the car in the backyard.

[dramatic music]

- hopefully, we're gonna find this caprice

that's parked in the backyard that was used in the shooting.

♪ ♪

narrator: He starts with a woman named diamond

who lives at the house.

- Listen to me.

♪ ♪

I'm tired, I'm wet, I'm hungry, and I'm trying

to get y'all out of here, so what I need to know

is whose caprice is that in the backyard?

Narrator: Diamond says fred jones,

also picked up at the house,

drove up in the gray caprice just after the shooting.

- Ok, who was with fred, though,

when he pulled up in the backyard?

- I don't know.

- you stay in here with this door shut, ok?

♪ ♪

- well...

You should be scared

'cause this is some serious [bleep].

- I'm gonna give you as much as I can, man,

'cause I really didn't--

I didn't know it was gonna go down like that.

- [imitates gunshots] yeah, it's like I--

listen, I know I see a gun, and it's cocked back

like this up.

I don't know what to think, what to do.

Was it jump out the car while it was driving, what?

- Mm-hmm.

- johnny, our alleged shooter.

♪ ♪

well, ain't that some [bleep].

♪ ♪

his sister, diamond peterson.

Narrator: Mullins discovers that he already has

the suspect's sister in custody.

♪ ♪

- hey. - No more lies.

Ma'am, I know that main is your brother...

but if you really want to help him,

you're gonna answer one simple question for me.

He hit the wrong person.

It could be a big difference to him,

but if he stays out, it's first-degree murder.

- [sobs quietly]

Narrator: Johnny says his sister diamond

turned him in.

- Man.

You are charged with first-degree murder, ok?

- First-degree murder. - Yeah.

- We conducted an investigation,

and upon our investigation, the results,

all the fingers point at you.

It was a courtesy to come and get you

- we got one man dead for doing nothing more

than standing somewhere.

that seem to be turning on each other

trying to save themselves, and all this

over just one bad decision.

It's just another sad story.

They will go to clubs, and the last thing

they expect--to be victimized in a homicide.

In this next case, a well-intended kid

went out to a club with his friends

and never came back.

- we got called out to a nightclub here

in the allapattah area.

♪ ♪

basically, we're gonna process the scene now

and go from there.

♪ ♪

- do we have an id on the victim?

♪ ♪

- yeah.

♪ ♪

- jordan rodriguez.

♪ ♪

narrator: Jordan rodriguez was 18 years old.

He was a high school student

and lived at home with his family.

♪ ♪

narrator: Jordan was shot once in the face

with an exit wound in the back of his head.

- He was facing whoever shot him.

♪ ♪

he had money on him, so he wasn't robbed.

He didn't have anything elicit--

nothing that would give me any indicators

of anything other than just a normal kid

who came out to a club.

♪ ♪

- right now, I got two witnesses

that were at the crime scene with jordan.

Apparently, they were in the club with him all night,

and they may have seen what happened.

Hopefully, we'll get something out of 'em.

narrator: Ruggiero and diaz head in

to question the victim's friend jack.

♪ ♪

- jordan, that kid was amazing, man.

That kid helped me out in ways that I couldn't believe he did.

♪ ♪

[sobs]

- it's all right, man.

♪ ♪

- I get it.

Just kind of tell us what happened.

Narrator: Jack says a group of men

were trying to start a fight

with them inside the club, and one of the men

elbowed jordan in the face.

We see them again.

Narrator: He says one of the men approached them

as they were trying to leave the parking lot

and pulled out a gun.

- It just shocked me when I see the gun.

♪ ♪

and then he pointed it at jordan.

He told him just like this.

♪ ♪

on the ground.

Then the kid ran.

He stopped for a moment, and then that's when I thought

then he's gonna shoot-- he's gonna shoot me.

He's gonna shoot me.

Narrator: Jack says he didn't see

the shooter or his friends leave

because he was running for his life.

- How many people are we looking at?

- had you seen these guys before?

♪ ♪

as a former detective,

it is not shocking to me

that a case like this

could escalate into a homicide.

We have a lot of club fights where a lot of young people

let their emotions get the best of them.

They do not know how to put their guns away

and just simply go home.

The best advice that I can give any young man--

be the better person and just simply walk away.

- the guy that shot him, what does he look like?

Narrator: Jack says the suspect appeared

to be a white latin male.

- There was nothing you could have done.

this is literally over nothing.

He shot him for no reason.

- that's a real tragic incident, man.

You know, guy's out trying to have a good time,

and nobody can bump into anybody anymore, you know?

turn to their second witness, renier,

hoping he can identify the shooter.

I tried to get the license plate,

and I kind of wrote it, on, like, the street

with a rock.

- hey, kevin. - Hey, sarge.

I just finished interviewing this guy right now,

and what he's saying is that--

right there where the victim fell--

that he grabs a rock and he scratches out

the first three letters of the getaway car.

- Really? - Can you see anything there?

- yeah, that's interesting.

♪ ♪

- x-p-f.

Let me run a partial and see what we can come up with.

- I haven't been able to find a good match.

narrator: Then...

Narrator: Ruggiero gets a big break.

they say they have a friend who knows the killer.

At this point, we're now at a green light

on jonathan. Snatch him up.

the felony apprehension team picks up jonathan roman.

- We're gonna talk to him now.

♪ ♪

jonathan, I'm sergeant herrera.

This is detective diaz.

You're here in the homicide unit, obviously.

- Yeah, you're in the homicide unit.

What would you be here for?

a lot of people know what you did

because a lot of people at that club know you, ok?

♪ ♪

this is your time to give your side of the story,

if you want to.

- that was easy. - Yeah.

- for whatever reason, good girls

are attracted to bad guys, and they find themselves

in very bad positions

and caught in the middle of their drama.

In this case, it resulted in a young woman

losing her life for something

she had absolutely nothing to do with.

- there's the man of the hour. - Oh, I don't know about that.

- there's two cars heading northbound on houston,

and one car shoots into the other car

striking and killing a female.

- her name is cristal gutierrez.

narrator: 19-year-old cristal gutierrez

was born in dallas, texas, and had recently moved

to tulsa with her parents.

she just graduated from high school

and dreamed of becoming a nurse

and raising a big family.

♪ ♪

- there's two rounds right here

that didn't go all the way through the door.

and then one went through the window.

♪ ♪

- those look like fricking 45s. - That's a big hole, yeah.

- apparently, the passenger was lucky as hell

'cause he's fine.

- pull up, and he's kind of running around, freaking out.

He's crying without tears.

And he said that he's had a girlfriend die before,

so I thought that was a little strange.

- sounds kind of shady.

- Does he say anything about anyone exchanging words

or seeing who's in the car beside him or--

- he told me car pulls up next to him

and shots and then they end up here.

♪ ♪

- I mean, he's right behind the doorframe right there.

- Yeah.

- And those rounds come through the window.

- I wonder if she was sitting up.

Narrator: Detectives believe the boyfriend may have been

the intended target of the shooting.

- Probably.

- Where's the boyfriend at? - He's downtown.

- Ok.

I'm going to the office to talk to this guy.

to figure out who did this, and, quite honestly,

narrator: He says they were driving downtown

when he saw a car suddenly pull up alongside them.

[imitates whooshing]

- for no reason. - For no reason.

- what'd the car look like?

- Two door, four door?

Why is your window down?

- Come on, man.

People just don't shoot people for absolutely no reason.

It just doesn't happen, honestly.

But we need to get to the truth here.

the intended target in this deal was you.

It wasn't her.

All those bullets, man, went right through your door.

you're incredibly lucky.

- why are they shooting at you guys?

- was there an issue with her and an ex-boyfriend?

There's a 19-year-old girl

whose life will never be what it should have been.

It takes a hero and a real man to step up

and do the right thing, and this girl needs you.

Her family needs you.

he robbed a mutual acquaintance

earlier that day

that he feel like has wronged him,

exacting his own justice,

and an innocent young woman finds herself

Narrator: He says he didn't see anyone,

but thinks there may have been

more than one person in the car.

Someone probably follows her from her work.

and they start shooting.

leatherman checks facebook for cristal's friend

and their mutual acquaintance hao.

- she's gotta have a picture of them together.

Narrator: The boyfriend confirms the identities

of cristal's friend

and the possible suspect hao le.

♪ ♪

- I found hao le in our database.

♪ ♪

he just turned 18 a couple days ago,

and based on

cristal's boyfriend's comments

that he's had issues with hao in the past,

he's definitely someone we're gonna have to talk to

and get his side of this story.

♪ ♪

- yesterday john made contact with hao's apartment manager,

and he just got a call that hao and some other people

are at the apartment, and there's a big rental truck

out in the parking lot, and it looks

like they're moving out, so we're gonna head out there

and make sure that it is hao

and see what exactly is going on.

♪ ♪

narrator: The team splits up into three different cars

and calls in warrant officers for backup.

♪ ♪

- man, right now, I just don't have enough

to make a good run at him,

so just gonna kind of see where he goes at this point.

- I can see the u-haul,

but I can't see the apartment

or anything else right at the moment.

- Nate and I actually have eyes on--

they're still loading stuff into the truck.

there she is.

Narrator: Brown spots cristal's friend.

Narrator: And their potential suspect, hao.

- I may be wrong, but I think the guy

in a black and white shirt is our guy

that's going to the driver's side

of that u-haul.

- if we can get her away from him,

I'd want to talk to her.

- Well, I think you're right, ronnie.

I mean...

- Yeah, I agree.

narrator: Cristal's friend gets into

a black four-door honda.

♪ ♪

narrator: Brown and schilling will follow hao

in the u-haul...

Narrator: While leatherman goes after cristal's friend.

- ok, just got a fresh green.

narrator: She claims that yesterday a neighbor

saw cristal's boyfriend, known as too short,

break into hao's apartment and steal his guns.

- so then what does hao tell you he's gonna do?

- the stuff that happened to cristal last night,

there's no way the people who did that

didn't tell the people who they're close to about it.

John and nathan have been watching hao,

and so they're gonna get him stopped

and bring him down here,

and hopefully he'll give us a statement.

Narrator: The team apprehends hao and his friend rey

outside of hao's new apartment.

I'm a detective here with the police department...

And I'm investigating the case,

and through the course of this case,

I've learned I need to talk to you about it.

that we're investigating?

- that's fine.

Based on everything else we have up to this point,

I have enough to arrest him.

That being said, we're not done

with the investigation.

We got to see if anyone else was helping hao

or if someone was in the car

when this shooting actually took place.

when he calls you right after the shooting,

what does he tell you then?

- he's like, "bro."

he's like, "I didn't mean to do it, bro, but, like,

"I was so mad, bro.

I seen his face, and I couldn't hold back."

- based on all the evidence we have

and all the people we've talked to,

I think hao was the only one in the car.

I think the case against hao is very strong now.

♪ ♪

- it sounds like hao and cristal's boyfriend

have had issues in the past.

♪ ♪

and because of their issues, cristal ends up dead,

and it's just a tragic situation

where she wasn't doing anything wrong

other than giving her boyfriend a ride.

she's just wrong place, wrong time.

♪ ♪

- it is scary for people to hear about people

being murdered for being in the wrong place

at the wrong time because they put themselves

in their place, you know?

That could have been me. My family members go there.

It's always difficult to knock on the door

of a family member and tell 'em

that their loved one has been the victim of a murder,

but when you have to tell 'em that you have somebody

that wasn't the intended target,

it's even more heartbreaking.

The family wants to know why. How could this happen?

My loved one didn't even live that type of lifestyle.

ever recovers from a loved one being murdered.
