escape conviction

from a crime on the basis of
the victim's consent to the danger.

However, there is another kind
of guilt that we're trying here,

that of the directing minds.

And we will make the chain
of responsibility clear to you.

Although Mr Ross's death was
brought about by Tendai Shoko,

it was causally linked to
gross negligence on the part

of Keith Hodgekinson and Roy Storidge,
who owed him a clear duty of care.

what the command structure was

for The Dungeon?

There's the controller of the
channel, who signs off on everything.

Next, there's the head of
department at the channel.

He commissions the production
company. I own the production company.

Mr Hodgekinson is a
producer. He hired Mr Storidge.

Why was the show commissioned?

With the success of the first six
series, the channel automatically

commissioned the seventh.

How were the inmates selected?

We've got a long interviewing
and auditioning process.

Who did the interviews?

Myself and Keith,
along with psychologists,

medical doctors,
fitness experts.

We formed the selection panel.

Was the second defendant
a part of that process as well?

Sure. He has to know how
far he can push the material.

for in these inmates?

lively, interesting, sexy challenges.

Mr Hodgekinson, the producer, and
the director, the second defendant,

took those meetings
and signed off on them.

Were they ignored?

I think they must have been.

I certainly saw the assessment
of risks, and they were low.

Did the channel commission the
seventh series on the same terms

- as all the others?
- No. They wanted some changes.

Such as?

They wanted it to be sexier,
livelier, more entertaining.

More dangerous? More
freaky? More scary?

Did you keep the power
of veto in this process?

Well, to some extent, yes.

So, the defendants
weren't the final arbiters

on who took part in The Dungeon.

- They certainly had a say.
