the French coast.

As other communities
have found to their cost,

the incinerator has resulted
in life-threatening dioxins

being released into
the atmosphere...

these injustices to my client.

link between the incinerator

and the health of the

In 1998, soon after the
incinerator was up and running,

Mrs Peacock started
to get flu-like symptoms.

It was winter, so she
assumed it was flu.

But they persisted and then her
husband developed the same symptoms.

Finally, his doctor suggested
that he might be suffering

from chemical poisoning from
handling treated wood. He's a carpenter.

Mrs Peacock being contaminated
by contact with her husband's clothes.

This persisted until in 2001,

Mrs Peacock gave
birth to their first child,

a boy, who lived only hours.
His heart and lungs were fused.

Around the same time,
another mother in the area

gave birth to a baby with
teratogenic deformities.

Several other patients at
the same medical practice

as the one that
Mrs Peacock attends

were also misdiagnosed with
these mysterious flu-like symptoms.

Are you implying doctors colluded
with Cardinal to disguise these facts?

I'm saying they didn't know
what they were talking about

when they blamed factors other
than chlorinated hydrocarbons,

that is to say, dioxins
produced by the incinerator.

Sir Alan Peasmarsh's

She's only got one
eye and no nose.

After what happened to Henri,
we started searching the Internet.

A pile of stuff came
up about dioxins being

carcinogenic, teratogenic
and mutagenic.

They're in pesticides and things,
but they also come from incinerators

where they burn chlorinated rubbish like
paper and packaging and hospital stuff.

And what did you do next?

We went to the council
and to the incinerator.

They just gave us the brush off.

Then my GP got keen on the
dioxins angle and started investigating.

But then suddenly she changed tack
and said my problem was hereditary.

I wouldn't accept that.

My new doctor went through my history
and couldn't find any hereditary cause.

What happened to your first
GP? Um, Dr Matthews, I believe.

She got a grant
to do epidemiology.

That's studying the cause of disease
in the community at Sussex University.

Thank you. Was this funded
by the health authority?

I don't know. I mean, I
think it was part of Cardinal's

dirty tricks campaign when
we started a public protest.

Do you have evidence that Cardinal
did anything at all underhand?

Well, no, not really.

Did your new GP find any other
patients who suffered similarly?

A boy with problems like Henri.

They thought that
pesticides were to blame.

His parents live next door to a
farmer's field that was sprayed a lot.

Where did this person live?

- Two miles from where I live.
- Within the incinerator danger zone?

between the birth defects

The health authority said that GPs
shouldn't be doing that sort of work.

It wasn't ethical.

radius of Peaks Farm incinerator?

The epidemiologist who
my GP got to look into it

said that it was too
high to be a coincidence.

The norm is 1 birth
defect in a 25-mile radius.

The unintended by-products
of industrial processes

which burn chlorine
with organic matter.

The principal source?

Incinerating waste, especially
paper waste and plastics.

Incinerated hospital waste
is a major source of dioxins.

More than local councils and
incinerator companies tell us.

- Do you have evidence of that?
- Yes. It's mostly kept secret.

Is there a solution to this problem
we have with rubbish in your opinion?

Cut down on the use of chlorinated
paper products and plastics.

the incineration at Peaks Farm.

Evidence of dioxins in the
chimneys throughout the range.

50% were in the upper
range of TEFs, one to four.

When dioxins
enter the food chain

they become embedded in fatty
tissue where they affect our cells.

Pregnant women are most at risk.

Dioxins cause spontaneous
abortion, birth defects, cancer.

They cause cells to
divide erroneously,

causing babies to be born with anything
from cleft palates to fused organs.

Chromosome damage occurs

producing gaps and breaks
in both skin and organ tissues.

- Have you seen such birth defects?
- Yes.

They're very disturbing.

Have you read the physicians'
reports on baby Henri?

Yes, I have.

Can you look at the photos in
your bundle marked C at 18?

Is that a photo of baby Henri?

Yes, at about three months.

Does the damage in any way correspond
with the effects of dioxin poisoning?

More or less exactly.

Is there anything
you wish to add?

I am puzzled at the
different dioxin levels

between what one would expect
from ordinary household waste

and those found at the plant.

They suggest a high
rate of PVC burning.

- Is that significant?
- PVC burning indicates hospital waste.

Because this contains far
greater quantities of chlorine,

incinerators are only
licensed to burn small amounts.

Burning chlorine at too low temperatures
causes such high levels of dioxins.

about sheep dip and the water
tables of England and Wales?

- Yes, I was one of its authors.

I'm doing no such thing.

before it became a

A timber-importing company.

Do chemicals used in
the treatment of timber

also cause dioxins?

Yes. I suppose it's possible.

practice, saying it was,

"harming workers in the
industry and their families".

was affected by dioxins,

it's possible that these came
from the treatment of timber,

not the efficient incinerator.

The question is what are
you going to do about it?

It's too late for impeachment.
Parliament has prorogued.

- Only the judges can stop him now.

We must proceed. The judges
must insist on his removal.

The judges accept that
he behaved shamefully,

but they are unanimous in this,

that to pursue Deed
now would seem as if

they're paying him
back for pursuing you.

That has no bearing, Joe.

Joe never said it had, only
that that is how it will appear.

- What do you say, Michael?
- Oh, I'd like Deed stopped.

This looked like the
means, but it's not to be.

- We could recall Parliament.
- I would advise against it.

Impeachment would never be achieved
on a vote in these circumstances.

No. I won't let this happen.

You have to be philosophical
about these things, Neil, like me.

will lose his job.

of the accusation.

This was a very difficult
judgment to arrive at.

On the one hand, we must try to
protect the individual and the community

from the effects of
potentially polluting industry.

On the other hand, we must recognise
industry's place in modern society.

Industry is a means of
providing both employment

and the products
that most people want.

Or in the case of Cardinal
Waste Management PLC,

the means of
disposing of the waste.

Therein lies the problem.

The most difficult part of the
case involving Mr and Mrs Peacock

and their daughter,
Henri, and Cardinal,

concerned two essential
points to be proven.

Causation and foreseeability.

It was shown that dioxins
caused the problem.

But was it brought to
their doorstep by Cardinal?

Well, from the report commissioned
by Cardinal from Mentor,

it's absolutely clear that Cardinal
knew that there was a problem

with the incinerator
plant at Peaks Farm

and that this problem
was due to a design fault.

Yet knowing this they
chose, on economic grounds,

to bear the cost of any
claims made against them,

cynically stating that any
damages awarded in a British court

would cost them far less than
shutting down and redesigning the plant.

So, in such a situation,
the law allows for exemplary

or punitive damages
to be awarded.

I'm therefore awarding damages
towards the care of baby Henri

of £105,000 per annum for life.

I'm awarding to Mr and Mrs Peacock
£500,000 for the loss of their home.

I'm also awarding damages
to Paul and Pauline Peacock,

of £3,500,000

for the distress this
teratogenic birth caused them.

These are my principal rulings.

In the meanwhile, I am
sending a report to the DPP

and I'm asking him to explore
the possibility of bringing charges

against both Cardinal and
Mentor in respect of injuries

caused to Mr and Mrs Peacock, baby
Henri and other members of the community.

All rise.

We will appeal.

George, the world is at last
