I was under the impression the
royal assent had already been received

for that vile piece
of legislation,

the Criminal Justice Act 2003.

The government intends to
revisit it either this year or next year.

With an incredible 339 sections

and 38 schedules,

it's already more complicated
than most people can fathom.

on how to simplify it

or to cut it out entirely?

They want to give it more teeth.

They're determined to extend
the section on trials without juries.

You'll not find a single
judge signing up for that.

Precious few were consulted.

Juries are not only becoming
less and less reliable,

they're also getting harder
and harder to empanel.

They're no longer economically
viable. I'm not sure they ever were.

What have economics
to do with justice?

The government removes the
right to trial by jury at its peril.

It's merely proposing
to reintroduce a section

that would allow defendants to
elect to be before a judge alone.

To further reduce
the remit of juries

is to run the risk of putting too
much power in the hands of the state.

Many cases could be dealt with
more efficiently by magistrates.

Their sentencing powers could be
further increased to, say, two years.

The judges wouldn't
stand for it. They'd strike.

trouble with these defendants.

the identity of its principal witness

by asking that she give
evidence via a video link.

Now, this is a denial
of a fundamental right

of my client and his

Under Section 51 of the
Criminal Justice Act 2003,

a witness may so appear
provided the court is satisfied

that it's in the interest of the
effective administration of justice.

totally prejudices a jury,

making them believe that the
defendants are so menacing

that the witness needs
special protection.

but it was repealed in 1972
by the Criminal Justice Act,

which neglected to state how
many jurors should be sworn.

what did you find?

I found a young oriental man
dead on the floor of one of the rooms.

He had two small
bullet holes in his chest.

A pizza had been
squashed on his face.

There was none in the
contents of his stomach.

Were you able to
identify this man?

From the hotel register, we
identified him as Simon Jackson.

This was later confirmed
by his fingerprints.

He was known to the
police as a drugs dealer.

He was part of a gang
called No Problem,

which was at the time at war with
another outfit called The Trigger.

Do you know or are you able to identify
any of the rival gang, The Trigger?

Each of the three defendants
are members of The Trigger.

And there are at least another two
on the public seating in court today.

Well, as long as they're not
doing anything to disrupt this trial,

A lady's handbag was propped
on a shelf behind the toilet.

We identified it as belonging
to one Rebecca Spark.

At first she claimed
she'd had it stolen.

Did she report it stolen?

No. And when we told her we found
her fingerprints in the hotel room,

she broke down, said
she'd seen the shooting.

Was she able to
identify the killers?

She gave us a description

and later picked each of the three
defendants out from photographs,

then from a videoed
police identity parade.

Was there any doubt about that?

At first she was reluctant to
identify them even on video,

the girl was terrified
that she'd be next.

She took a lot of reassuring.

Can you tell us again how
you identified Rebecca Spark?

From her fingerprints
found in the hotel.

So, when you went to interview her
and she said her bag had been stolen,

you took her fingerprints,

as you presumably do
with all victims of crime.

No. Her fingerprints
were on record.

If this prostitute hadn't identified

would have considered

the girl, or her lover, or her
brother, or father as suspect?

The jurors are only human, and
you are likely to prejudice them.

going to get you a retrial

or aid any appeal in the
event of a guilty verdict,

then I must tell you
that the appeal court

will read the
transcript of this trial,

and they will see that
you have been warned.

In any event, I will inquire
of the jury at the end

to see if they've been influenced
by events in the public gallery.

Sussex police are refusing to
provide protection for the jury

because the defendants
are London overspill.

They want the
DCA to agree to pay.

The criminal justice budget
can't go on expanding,

as much as we might
argue for it to do so.

The government must legislate
for us all to be good and honest.

that will do just that.
