evil scheme.

You're preying
on an individual that thought

he was going to have
some type of a sexual activity with a female.

[man 2] He was pleading
for help for his life.

No one answered him.

[man 3] The moment
I mentioned his name,

my friend goes, "Get everyone
out of that house, man.

That's a crime scene."

If they did it in Indiana,
Texas, who knows what they were gonna do next?

They had nothing to lose.

[man 4] They were trying
to live out

a version of
Natural Born Killers.

The coast-to-coast
crime spree.

Stealing, killing.

She was willing
to use her body

to manipulate men.

[woman] He's evil.
He's a monster.

And he could charm
a nun out of her habit.

[Mike Sherfick] Speedway,
Indiana is the racing capital of the world.

Where the
Indianapolis Speedway is, the Indianapolis 500.

[Stacy Kaiser] In 2000,
Speedway became known for a very different type of race.

The hunt for a vicious couple

luring men into
a violent and tragic end.

I was notified
on September 12th, 2000,

at approximately 6:58 am,

of a car fire

on State Road 67,
in the Decatur Township area

[siren blaring]

[Larry Sanders] I followed
the homicide detective from Morgan County

up State Road 67,

and you can see
the car on fire.

Looked like someone
had poured fuel

or some type of accelerant
into the vehicle,

and set the inside
of the car of fire.

[Ron Byron] The front
of the vehicle was totally engulfed.

As the firemen
extinguished the fire,

and popped the trunk,

they noticed that there was
a body that was

bound by wire

with hands and feet hogtied,

in the trunk of that car.

The person was burned
beyond recognition.

[Sanders] The smell
of a burnt body will stay with you forever.

The officers
on the scene

actually utilized
the plate number

and the vehicle
identification number.

and got a return
of the owner of the vehicle.

The VIN number of the vehicle
comes back to Robbie Bott.

Records indicated Robbie Bott
doesn't live in Indianapolis,

he lived in
Morgan County, Indiana.

So that is within
a different jurisdiction.

[Downing] The first thing
that we need to answer is "What happened?"

Why are we here?"

And how did the vehicle
get from the residence

ten miles away
from our location,

and why is there
a body in the trunk?"

[Byron] The next step is
to identify, for sure,

who the person is,
in the trunk.

[Sanders] If it's not
Mr. Bott, who is it?

If it is Mr. Bott,
who's mad at him enough to take it out to this extreme?

Around 9:00 a.m,
after leaving the vehicle,

I had proceeded back down
to Mr. Bott's residence.

[Downing] Deputies attempted
to make contact

at the front door
of the residence,

and were unable
to get anyone to answer.

They went around
to the back of the residence

where they found
the rear door unsecured.

There were no signs
of forced entry on the door,

no pry marks on the door.

[Downing] They looked inside

and they found that
the residence had been ransacked.

[Byron] At that point,
there's a search warrant

executed at
Robbie Bott's house.

[Sanders] There was
glass broken.

There were items
that had been busted.

Furniture was tipped over.

Thought maybe it was
a home-invasion gone wrong,

and the homeowner
put up a fight.

[Downing] There were
some blood droplets in the kitchen,

cut pieces of rope.

There was a condom
beside the master bed.

So it appeared that
there was activity

with more than once person
that occurred there.

[Kaiser] Police have
an unidentified body in the trunk of a car,

and a home that looks like
it's been ransacked.

Now they also
have evidence

that this crime may have had
a sexual component to it, as well.

It's becoming a more and more
explosive situation.

[Downing] Every flat surface
was fingerprinted.

We were able to find
a set of fingerprints

behind the refrigerator
door pull handle.

But most of the items inside,

the residence itself
had been wiped off

with what appeared
to be a damp cloth.

[Byron] They found
swirl marks

all around every single
doorknob in that house,

which told them one thing.

Somebody was there
before the police,

and they attempted
to conceal their presence.

[Sanders] The next morning
on September 13th,

the pathologist was
able to confirm

that it was Mr. Botts
in the trunk of the car.

He then advised us
that Mr. Bott had also been shot.

And there are signs
of strangulation.

It's like someone
wanted to make sure this guy didn't live.

[Downing] According
to the autopsy report,

there was no soot
in Mr. Bott's lungs.

We knew at that point in time
that Mr. Bott wasn't killed in the trunk of that vehicle.

The fire was nothing
other than an attempt to cover up evidence.

[Byron] Robbie Bott
was an aircraft mechanic.

We were able to contact
Mr. Bott's mother and father, who were in Illinois.

We had to confirm that
it was their son Robbie who had been killed.

And it was not easy
to tell him that,

especially the way
that he died.

They agreed
to travel over to Indiana to meet us up at the house.

His parents were contacted
by that sherrif's department

to try to learn,
"Are these things normal for his house?"

Why would he leave
stereo speaker wire out?

Why would things
be cut up on the floor?

They said, "No,
that's not like Robbie, at all."

If you can imagine
working on an aircraft, you have to be very meticulous

with your work, your tools.

And he was the same at home
so his home was very clean.

Well kept.

[Downing] We were able
to do a walkthrough with family members

after the scene
had been completely processed.

They pointed out things
that were missing.

Like three mirrors
that were hanging above the entertainment center.

A vacuum cleaner.

[Byron] The Morgan County
Sheriff's department canvassed the area

of Robbie Bott's neighborhood,

asking neighbors if they saw
anything suspicious in the recent days.

At least one neighbor
told investigators

that there was a car
that they'd never seen before

in the driveway,

with things being
loaded into it.

They couldn't get much
of a description of the people or the things,

but it matched with what
the investigators found.

[Downing] Some of
the questions we had

specifically at
that point in time

were, basically, "How?
"How did this happen?

How many people
were involved?"

There was just
a whole lot of unknowns

at this point in time
in the investigation.

Investigators believe
that Bott, possibly,

may have been abducted
and brought to Speedway.

[Sanders] On the following day
the local news covered the story of the homicide.

I just plead to you people
to please...

give us the help
that we need.

[Sanders] It was basically
something that people

just didn't hear about much,
in the town of Speedway.

The sheriff and chief deputy
made a press release

that an individual
from Morgan County

had been found deceased
in the trunk of a car in Marion County,

and if anybody
had seen or heard

or had any information on it,
to please give us a call.

We got a few calls of
people who were saying, "Hey, I saw this car,

and it was this date
and time."

But we just keep running
into a dead end.

It's like
it happened at this time but no one saw anything.

[Sherfick] On September 13th,
I remember coming on the news

that a car had been
caught on fire on State Road 67

and that a body
had been found in the trunk.

I didn't think
anything of it.

A couple of days later,
we were cleaning a property that had been in my family

for 40 or 50 years

and I was gonna turn it
into a rental property

for the first Formula 1 Race.

I live about two miles
from the track.

Some of our laborers
were, basically, throwing stuff away,

taking some stuff out,
and then they found a wallet.

I then started
going through the wallet,

found credit cards,

Robbie Bott's employee ID,
his driver's licence.

I have a background
in law enforcement,

on and off,
for about 19 years.

So I called
one of my friends

who are still
on the police department.

I've put in
a cross-reference,

the guy's address and name,

and see if you can get

Morgan County dispatch
to get him my phone number.

I was gonna call the guy
and tell him, "Hey, I found your wallet."

And the moment
I mentioned his name,

my friend goes,

"Can you repeat
that name for me again?"

I told him and he goes,

"Get everybody
out of that house, man.

That's a crime scene."

[Sanders] On September 14th,

our dispatch
called me at home, saying,

"You working
the Robbie Bott homicide?" I said, "Yeah."

"You need to get
to Speedway, Indiana.

They just found
his driver's licence."

Now we've got a third
crime scene, basically.

The car was first.

Robbie Bott's house
was second.

Now we got a third one
in the house, up in Speedway.

We got there
as fast as we could.

[Sherfick] Speedway
Police Department showed up.

Along with the Morgan County
Sheriff's Department.

My reaction was,
"Wow, this is going to be

a difficult house
to sell now."

[laughs]

[Downing] We arrive
at the residence.

Mr. Sherfick,
the property owner

explained to law enforcement
on the scene

that the tenants that were
in this resident, at the time,

were Tess McFarland
and Joshua Maxwell.

[Sherfick] In September
of 2000, I hired Josh to come and do some work for me,

to basically
carry out everything

that was my grandmother's
that we were throwing away.

I knew Josh through my mom.

My mom and his mom
had been friends for a long time.

And my mom had
asked me to do a favor and give him some work.

He'd just
gotten out of prison,

and needed a second chance.

It was my mom,

so second chances come around
when your mom asks,

so that's what I did.

Josh and Tess
actually moved in together.

And they had a kid too.

Toddler.

And I allowed them
to stay on the property while they were doing the work.

Joshua exuded the attitude
that he was a badass.

He was definitely

cocky or bullish.

He didn't intimidate me.
But I would venture to say

if you took Josh and Tessie,
put 'em side by side,

you could tell
who the leader was.

She wasn't a big girl.

He was a pretty
stocky, stout guy.

And you could tell,
you know, you had some strength behind him.

[Joshua Maxwell speaking]

[Sherfick] My recollection
of Tess and the way that she acted,

she was willing to

use her body as a woman

to manipulate and get men
to interact.

I would show up
at the property and see how their child

was walking around
with nothing but a dirty diaper on.

They couldn't afford
to go get diapers.

So I ran up to the store

and bought 'em
a case of diapers that day.

Josh and Tess
lived in the property for maybe two or three weeks

before Josh actually damaged
some of the work that we had done,

and I'd gotten upset with him
and told him

that he needed
to pay for the material to be replaced.

It wasn't much.
It was a couple hundred bucks.

And then on the morning
of September 12th,

they were gone,
all their belongings were out.

But where was the kid?
I think the kid was with Josh's mom, not hers.

When we walked in,
part of the crime scene

had appeared to have been
cleaned up

with muriatic acid and bleach,
where they poured it on the steps.

Wiping the blood off,
and on a few spots

on the floor,
you could smell it.

The bleach was really strong
and it burns your nose.

And they'd also poured it down
on the basement,

trying to clean up
the crime scene down there.

It appeared that something
had been drug up the stairs,

that had left behind blood.

And then this acid
was poured on top of it,

in an attempt to deteriorate
any type of DNA evidence that could be obtained.

Once we got to the basement,

we found a wooden wardrobe
that was laying on its back.

There was a resemblance
to a medieval coffin, to be honest.

There was no access
for light.

It was very rough wood,

lots of splinters.

[Sanders] There were strings
and wires tied onto it

to where you close it
and you could seal a person inside of there.

They tied him up,
put him in there,

and then they tied
the armoire

and left him tied up
inside of that.

They were keeping him captive,
and they were controlling him.

I'd never seen
anything like that.

It was even new
to some of the other veteran guys there.

"How can somebody
do that to another person?"

Inside that wardrobe,
we found a pillow and a blanket.

The pillow had
a couple of bullet holes through it.

And also blood, as well.

Our evidence tech,
Dan Downing,

looked at me and said,
"Larry, he was killed in this."

And he pointed to
three bullet holes in it.

And he goes,
"There's the blood.

Someone was shot in this."

[gun firing]

We also found
the personal items

that the family had described
that were taken

from Mr. Bott's house,

either in the garage
or in the house itself.

Everything started
falling into place now.

[Kaiser] This crime
seems to involve robbery, sex,

and now, even an element
of torture.

Why would they have held
Robbie Bott captive?

Was this some kind of
a sex-play gone wrong?

What were they after?

[Downing] We started
developing who Maxwell and McFarland were

so that we could start
trying to track them down.

[Sanders] Who are they?

Where do they hang out at?

Who are some friends
or associated of theirs?

They can point us
in a certain direction.

[Mondo] Joshua Maxwell
was born in Indianapolis in 1978.

There are conflicting accounts

of how bad his life was
growing up.

A lot of his family members
said he had a loving home.

Others painted
a different picture.

That his stepfather
was incredibly violent

and very abusive.

[Sherfick] I knew his stepdad.

I would probably
describe him as

just poor.

Living below poverty level

struggling,
trying to get by.

Joshua is also
sexually active at a very young age.

I mean,
he had a kid around 13.

He also had
a problem with the law

from the time
he was very young

with property crime
and some vandalism.

Joshua Maxwell,
as an adult, was convicted of a felony burglary

and actually
served three years in Indiana prison for that.

[Mondo] He gets out
in March of 2000.

He was 22.

And it is through
his stepsister,

that he meets
Tessie McFarland.

Tessie McFarland
was close in age to Joshua Maxwell.

Her home life seemed like,

you know,
what you would consider

a typical, midwestern,

or any really
loving upbringing.

She seemed to be normal.

Even somewhat popular.
She was a cheerleader.

She was a very pretty girl

who was going to school
she has her friends.

Doesn't really
get into trouble

Everyone seems to like her.

But as she's a teenager,

and sort of hangs out
with a different crowd,

I think that
a lot of her self-worth

seemed to come
from men in her life.

Tessie got pregnant
around 17 or 18.

And she found a job
cleaning houses.

But she started
stealing checks,

and she got caught for that.

And she ends up in
the criminal justice system.

So now she is limited
in the types of jobs

she can get to support herself
and her son.

In 2000, Tessie started
working at

one of the area strip clubs,
as a dancer.

And through
Joshua Maxwell's step-sister,

who also worked there,
she eventually meets Josh.

When Tessie and Josh meet,
they are 21 and 22.

It is this immediate,
almost explosive attraction.

And they spend
so much time together.

They become
each other's person, if you will.

They're both young,
but in terms of life experience,

Joshua had so much more
than Tessie.

He is very much
a ladies' man.

What Tessie
seemed to bring to it

was this need for freedom,

no responsibility
and adventure.

They were the couple

that you looked at
and you just think

"I don't know
if this is gonna end well."

[Sanders] We asked
Mike Shefrik, the homeowner,

does he know
where they're at now?

What kind of car do they have?
Or anything.

He gave us
a phone number for them.

When we tried
to check the phone, see where it was at,

the phone was
no longer in service.

It was just a dead end.

We had our two suspects.

We just didn't know
where they were at.

We were trying to figure out
exactly when and where and how

Mr. Bott's credit cards
had been utilized.

At that point,
we were able to find

that there are transactions
to different stores

that we know
those credit cards had been used

to purchase
big-ticket items.

One of those areas
was Lafayette Square Mall.

[Sanders] Surveillance video
shows the three of them,

Robbie Bott, Josh Maxwell,
and Tessie McFarland were in the store.

Tess and Maxwell
were both very calm.

They were picking up items
off the shelves.

They were joking.
They appeared to be having a good time.

Mr. Bott, of course,
you could tell, was in a large amount of distress.

But he pretty much kept
both hands on the cart

and pushed it
and followed them through the store.

This is the chilling part
and this is the part that I don't forget.

The video tape showed
Robbie Bott

looking up at the camera
on the ceiling,

at the store, mouthing
the words,

"Help me. Help me."

[Sanders] His lips
were moving but you couldn't hear what he's saying

'cause there's no audio.

The camera was catching it
but nobody else was.

He was pleading for help
for his life

and no one answered him.

At this point in time,
we know who our potential suspects are.

Tess McFarland
and Joshua Maxwell.

Their motive
was clearly financial gain.

Not only taking the items
from Mr. Bott's house,

but also taking him
on shopping sprees.

But we have no idea
where they're at.

[Sanders] We're worried
now that they're on the run,

if they've killed once,
will they do it again?

[Downing] So we then send out

information to all
law enforcement agencies

across the United States,

that we're looking
for these individuals.

We gotta find these people
and get 'em off the streets.

[Downing] We still don't know
exactly how they met Robbie Bott.

But we learned
from phone records

and also from
his close friends and coworkers,

that Mr. Bott did
a lot of dating of different women.

He was into sexual experiences
with females.

He loved to have sex.

[Downing] Apparently,
Mr. Bott had answered an ad on some type of a dating site.

And arranged to meet
with McFarland and Maxwell.

As part of
this seduction of anybody that would respond

to this invitation
to meet Tessie

and to have sex with her,

Maxwell would
have to be present.

He would be in the room
or be nearby.

[Downing] We did
find evidence that sexual activity did occur

at some point in time,
in the residence.

We also believe
that that's probably why

the sheets and other things
from the residence were located in the washer.

'Cause there was some type
of a sexual event that did occur.

It was a very evil scheme.

Basically, they were preying
on an individual

that thought he was going to
have some type of a sexual activity with a female.

And then, all of a sudden,
a male shows up

and things go
downhill from there.

When Robbie Bott realized
this was, in fact, a trap,

it was too late for Robbie
to escape that house.

[Kaiser] It seems that Josh
is pimping out his girlfriend.

They're using Tessie's
sexual magnetism

to bring men
into their control,

so they can rob them.

But how did this case
go from robbery to murder?

[Sanders] Josh found,
as one detective called it, a pigeon.

He's got a nice home.
He's got all this nice stuff,

lives in a nice neighborhood.

[Downing] This was a crime
of opportunity, of course.

If McFarland and Maxwell
would have met some other individual

that didn't live
in a nice house,

and didn't seem well off,

these things may not
have happened.

But it was the perfect storm.

[Sanders] I think Josh was
controlling Tessie, a little bit.

"Do this for me, honey.
I love you.

Come on, you won't get hurt.

You know
you're the one for me, and I'm the one for you.

But we can use
the money.

He's got nice things
at his house.

You've always wanted
a nice stereo. Come on."

[Sherfick] I know
Josh is a criminal.

I don't know
what he's capable of doing.

It was surprising
that he went from burglary to murder.

It's unclear to me
whether Tessie knew how it was gonna end.

[Sanders] They took control
of Robbie Bott.

They held him at gunpoint,
kept him up in Speedway Indiana.

And when he runs out
of his usefulness,

"We'll get rid of him.
We'll kill him." And they did.

[gun firing]

[Downing] With the violent
spree that they had been on in Indiana,

we didn't assume
that it would be very long

before they were stopped
at a traffic stop

or committing another crime
somewhere else.

[Mondo]
On October 12th, 2000,

a young girl,
I think she was about 12,

she went behind
a shopping mall

here in San Antonio

and she found
a man's body.

Police were
immediately called.

The man had been bound
and gagged and shot in the head, execution style.

His hands had been tied
behind his back.

And a shirt had been placed
over the hands,

effectively rendering him
unable to do anything and defenseless.

There had been
a bullet wound to the top of the head,

and a second bullet wound
to the body.

It was determined
that the body was that of Sergeant Rudy Lopes.

who worked for
the Bexar County Sheriff's Office

as a detention officer.

He was 45.

He had been
with the department about 15 years.

His weapons are missing,
and his truck is missing.

[Kopp] During the course
of the investigation,

the police found out
that several people

had heard gunshots
at around 9:00 or 10:00, the previous evening.

There was a karate studio
at that particular location.

Several students
had notified the instructor

that there was
a gold Chevy Silverado

parked behind
the Strip Center.

And they saw
two individuals in the truck,

a man and a woman.

A few days later,

the car was recovered
at a mall in San Antonio.

And it had been
parked there for a few days.

The officer who approached it
determined

that it was wanted
out of a homicide in Indiana.

At that point in time,

they contacted Indianapolis

and spoke
with Captain Joel Rush.

He informed them
that there'd been a killing in Indianapolis

that he was investigating

in which Joshua Maxwell
and Tessie McFarland were suspects

and in fact there was
a murder warrant outstanding for them.

[Downing] We were notified
a corrections officer

wit the Texas Sheriff's Office

had met with two individuals
under the same circumstances

to Mr. Bott.

And online dating
type of an ad that he had answered,

and then the deputy
was killed.

[Mondo] What they did
to Sgt Lopes,

I don't wanna sound gruesome,
it took some time.

They had him tied up.

They had him gagged.

They had him there
for a certain amount of time

before they kill him.

[Sanders] I remember
Captain Rush calling me and saying,

"Our suspects are in Texas.

They've killed
a police officer down there.

There was an incident
similar to what happened to Robbie Bott."

I was sad, I was like,
"Why couldn't we stop 'em earlier?"

Now someone else
has had to die because of these two.

And to make it
a law enforcement officer, it even hit closer to home.

[Kopp] As
the investigation progressed,

they discovered that
there'd also been a withdrawal

from the ATM machine
on the same day that he died.

And from that,
they got a picture

of the person
who was driving Rudy's truck.

[Mondo] It wasn't
the crime of the century.

They weren't
hiding their tracks.

They're not thinking of,
"Well, if I take this car here,

"they're gonna know
who it is."

There's just evidence
everywhere.

San Antonio police,
very quickly,

announced that
Tracy McFarland and Joshua Maxwell.

were persons of interest
in the case.

They didn't
have them definitely as the actual murderers

but they knew that,
"Okay, this is all matching up,"

and they needed help
finding them.

'Cause they were just
in the wind.

[Downing] We had a sense
that they were gonna commit another crime,

simply because
they had a limited amount of money.

We had no idea
where they were going to go.

Or where they were
gonna end up at.

But ultimately,
at the end of the day,

we knew if we just
sat patiently and waited,

they were gonna pop up
somewhere along the radar

because this was
just now their pattern.

They were on a crime spree,
and they had to survive somehow.

[Kaiser] Josh and Tessie
have developed a crime they can commit anywhere.

Lure a man in
with the promise of sex.

Then take him
for everything he's got.

If they run into trouble,
they can kill him,

as they've done
twice already.

The question is,
"Where are they headed next?"

They did it in Indiana, Texas.
Who knows what they were gonna do next?

They had nothing to lose.

[Byron] I thought
they were trying to live out

a version of a movie called
Natural Born Killers.

A coast-to-coast crime spree.

Killing, stealing,

doing whatever they did
across the nation.

I think these two

were trying to go out
in a blaze of glory.

[Mondo] This case
moved so quickly.

With the killing
of Bott in Indiana,

that was their first victim.

And then a month later,
you have Rudy Lopes.

After his killing,
things moved even faster.

[Kaiser] This couple
has clearly honed a method that's working for them.

And if they're getting off
at the thrill of the kill,

they could strike again
at any time.

But in the heat of the moment,
people tend to make mistakes.

[Mondo]
San Antonio police know

that Sgt. Lopes's
truck is missing.

So the information
that goes out to law enforcement,

across the country,

is "We're looking
for this truck.

It is connected to
a homicide of this person."

All evidence
pointed to them

most likely being the killers.

But it wasn't until
everything plays out

in San Francisco

that it all comes together.

On October 17th, 2000,

which happened
to be the same day

as Sgt. Lopes's funeral,

a cop in San Francisco
tried to stop

a pickup truck for speeding.

They run the plates.

And they realize
it's connected to a homicide in San Antonio.

[Byron]
Joshua Maxwell takes off. There's a brief vehicle chase.

And then gunfire is exchanged.

[Kopp] Joshua Maxwell
fired out the window.

And it struck
the windshield

of the patrol car
being driven by two officers

that then continued to pursue.

[Mondo]
They're shooting at cops. Cops are shooting at them.

Cars are getting
their windshields blown out.

It was a mess.

Tessie was shot in the neck.

Eventually, the truck
gets stopped.

And that is when
they're able to actually move in on them.

Joshua Maxwell was arrested
and taken into custody

and Tessie was taken
to the hospital.

[Sanders] It was on the news

that individuals
wanted for murder

out of Indiana and Texas

were apprehended
in California.

It was a huge relief.
They were off the streets now.

Two people lost their lives.
There's not gonna be a third.

I have no doubt
that there would have been more deaths that had occurred

just because of the way
that there two were operating.

[Kaiser] They had found
a crime that worked for them

and they would have continued
looking for men to victimize,

if they hadn't
have been caught.

They were truly predators.

[Sherfick] I was surprised
that Josh was taken alive.

I figured he'd put up
a bigger fight.

He'd made the comment
that he wasn't gonna go back to prison.

That can mean two things.

One, "I'm not gonna
do anything wrong."

Or two, "I'm not going
back to prison."

[Byron] Maxwell
and McFarland are arrested.

They're in San Francisco,

and then interrogated
by San Francisco police.

[officer speaking]

[officer] Okay.

Josh Maxwell admitted
that he went to Robbie Bott's house

and stole items.

And then he went
on a shopping spree

that was captured
by store video.

Robbie Bott realized
if he did not co-operate,

he would put his family
in jeopardy

because he was threatened
by Joshua Maxwell

and Tessie McFarland

that, "If you don't do
what we want you to do,

we know
where your family lives

and we will visit them."

So, I was...

[officer] Okay.

[Byron] Robbie Bott
knew that he was going to meet a certain death

while he was
in that basement.

With the suffering that
he must have went through, being helpless...

You can't call out.
You're not going to escape.

You're at gunpoint.

Joshua Maxwell
was not quiet about what he had done.

He confessed numerous times

to the killing of Robbie Bott
and Rudy Lopes.

[Kopp] There was absolutely
no remorse from Joshua

for the crime he committed
in Texas, or Indiana.

He did not, and would not
implicate Tessie.

He said
he'd pulled the trigger and that he did the killing.

One agreement was made
between the prosecutors in Indiana, and then Texas

that Mr. Maxwell
would confess to the crimes

and give details
to how all these things were evolved

as long as Tess McFarland
was just given life imprisonment

or a prison sentence
instead of the death penalty.

[Byron] He said that
he threatened her

that he would kill her
should she go to the police

or try to escape as well.

And that just didn't fit
with any of the evidence

as far as the investigators'
and my opinion.

[Sanders] The video
of them shopping shows that it was just one big game.

"We're just playing the game."

[Byron] Tessie and Josh
look like they were on a shopping spree.

A love affair,
looking at jewelry,

laughing, carrying on.

[Downing] Tess was
a willing participant in all of this.

She had ample opportunities
to walk away.

And Mr. Maxwell
would have had to deal with Mr. Bott

instead of chasing after her.

She chose not to do that.

[Byron] Tessie always
maintained

that she was a victim,

that she was in
an abusive relationship.

But she was part
of the crime to lure

Robbie Bott,
to this house.

[Kaiser] There's no question
Tessie had to be the seducer

in order to bring in
their next victim.

But she may have done it
because she was desperate to please Josh,

no matter what the cost.

[Mondo] I don't think
she knew how to get away.

And at that point,
I don't think

that she wanted to get away.

She had said
that she was scared.

And she was scared of him,
and she was scared of what he would do.

And I do think
that is true,

because it took
such a violent turn.

But at the same time,
she helped lure Sgt. Lopes.

She didn't do it just once
and then get out.

[Downing] Part of the evidence
that they were able to seize after the arrest

were tapes of
the two of them having sex while they were on the run.

[Byron] It's sickening

that these two
did what they did

and then partied afterwards.

Like a celebration
for the heinous crimes that they committed.

[Kopp] Just a two-man
wrecking crew going across the country

dong whatever they wanted
and killing anybody who they thought got in their way

or could offer them money.

There was no issue
in our mind that Josh was a danger to society.

We sought the death penalty.

We weren't gonna accept
anything less than that.

[Downing] I've been with
the Sheriff's Department for 27 years,

and 20 of those years
in investigations.

I have never seen a crime
this violent and this cold,

and this ruthless.

[Mondo] There were
way more questions than answers,

from all of it

about how they ended up
where they did.

From Indiana to Texas,
what did they do for money?

And from Texas to California,
"What did they do for money?"

[Kaiser] The likelihood is,
that Tessie and Josh robbed other men along the way.

Men who didn't
report the crime

because they were embarrassed
by how they got snared.

The only difference is

that Robbie Bott
and Rudy Lopes ended up dead.

[Mondo] After the arrest
of Joshua Maxwell

and Tessie McFarland,

there were talks
between all of the jurisdictions,

back in Indiana, in California
and here in Texas,

of where they wanted them
to be tried first.

[Kopp] There was
a full-court press by everybody

to make sure
that justice was done for their victims.

[Mondo] Everyone decided
that Joshua Maxwell should go to Texas first,

because he had
the highest likelihood of getting the death penalty.

[Kopp] When Josh and Tess
arrived back in San Antonio

they were indicted and charged
with capital murder, each of them.

We tried Josh first.

The trial of Joshua
in the courtroom was very intense.

We had a long,
long list of witnesses,

just to present the evidence.

[Downing] I presented
the crime scene for Indiana.

as one of
the aggravating circumstances.

Maxwell was very smug,

and seemed to be very cocky.

He seemed to be proud
of what he'd done.

[Sherfick] On the day
of my testimony in Texas,

Josh sat there
staring at me, the entire time.

He would move his lips
or clench his fists on the table,

trying to be intimidating,
I believe.

But he didn't look like
he had any remorse at all

about what had happened.

[Mondo] The evidence
against Joshua Maxwell was overwhelming.

I believe that the jury
only took four or five hours.

In 2002, Joshua Maxwell
was found guilty of capital murder

and received
the death penalty.

There's no question
in my mind, if he had the chance,

he'd commit
future acts of violence,

so I felt
that justice was served.

[Mondo] One of the things
that really struck me about the trial

was Joshua Maxwell's family
was here.

His mom and sister saying,

"Say your prayers.
We love you, and we're here for you."

And that's the thing,
he seemed to always have that support.

A year later,
Tessie McFarland

took a plea deal
with a confession

and got a life sentence.

So she is eligible
for parole

in 2040.

[Byron] After Joshua Maxwell

was convicted in Texas
of capital murder,

we made the determination

that we need to bring
him and Tessie back

to Indiana,
to face justice

for the heinous crimes
that they committed against Robbie Bott.

After a three-day trial,
the jury was out

for approximately three hours
and convicted Maxwell on every single charge.

In Indianapolis,
when Joshua was sentenced,

he got 65 years.

So it's basically
a life sentence.

[Byron] We made
the determination at that point

to seek a guilty plea
from Tessie McFarland

on some
of these serious charges.

[Byron] I had an interview
with Joshua Maxwell

after his conviction
in the Indiana case.

We needed to, what's called,
do a cleanup statement

to learn any other information
that he had about these crimes.

And I'll tell you,
he was intelligent

and dangerous.

I just don't know
why this young man

who, to me,
was an intelligent person,

committed such evil acts

unless, he himself
was evil.

If Joshua Maxwell
had not met Tracy McFarland

would he have
become a killer?

And my answer
is probably yes.

You know, this was probably
inevitable for him,

at some point,
'cause he was so angry,

and not in any way able to
control that side of him.

If Tessie McFarland
had never met Joshua Maxwell

would Tessie McFarland
have become a killer?

And my answer is no.

I spent an hour
with Joshua Maxwell. He's a death row interview.

In that interview,
he was so charming,

and so charismatic...

I had read
everything about him.

He's evil,
he's a monster.

And then I met him,

and he...
He could charm a nun out her habit.

People want to see evil.

They wanna think
they can recognize it,

that they will
never be conned,

that they'll never
be taken in,

and I guarantee you,

if you didn't know
his history,

you would likely be taken in
by Joshua Maxwell.

losing control of
your little girl.

Someone slaughtered her
in her own living room.

It was just like a rage.

This was a guy that thought he
could get away with anything.
