if he felt threatened.

get help from the authorities,

and that he could not get away from
Billy Trammell and the Brotherhood,

inside the prison or out.

He felt the Brotherhood
would find him,

hunt him down,
no matter where he went.

Your client's subjective belief about
the danger is one thing, Mr. Fallon.

But the law also requires that
that belief be objectively

reasonable under
the circumstances.

I have 109
incident reports

from the New York State
Department of Corrections,

which document violence
perpetrated by the Brotherhood

in the last five years.

And these are only the ones that were
reported. The tip of the iceberg.

No one denies the
Brotherhood is dangerous.

The issue is whether the
defendant was allowed to make

an anticipatory strike against
one of their members.

And hundreds of years
of jurisprudence say no.

there was no Brotherhood.

for their lives.

And then I gave my son
Sean my .38, just in case,

raised, the gun cocked.

Deadly force only in response to the

It's a bright line, and there's
a reason we don't cross it.

We cannot ascertain
motive after the fact.

We can't know what was
in Billy Trammell's mind.

We can't know if the
Brotherhood's threats were real.

And we can't ask him now, because
he's dead. John Worley killed him.

allegations could be investigated.

These threats
were not imminent.
