to murder the Indian agent.

beyond the shadow of a doubt

have committed the murder

of which he's been accused.

or the desire
to commit this murder,

On the 21st night

the Indian agent,

on the road
in the Nueces territory.

Earlier that evening,

he had dinner
at your cafe, right?

Well, while he was
having dinner,

Gene Matson, the accused,
entered the cafe

and sat at the table
with him, right?

Uh, Gene stopped in

to have a cup of coffee
with Sean.

Well, you told me
immediately after the crime

that they had
a violent argument.

Well, uh, no.
They--

There was some loud talk.

But-- Well, th-that Indian agent

always had a lung full of air.

I wouldn't say
they was arguin', uh,

I'd just say
they was talkin' loud.

You told me that Sean
accused Gene Matson

of trying to steal
the Indian lands.

Oh, no, sir.

I-I went back into my kitchen
about that time,

so I didn't hear nothin'.

Are you positive?

is repudiating the statements
he made to me,

and as far as I'm concerned,
I consider him unreliable.

a half hour later.

I'd say about 7:00.

Sean, the Indian agent,
left the cafe at 6:30,

and Gene didn't leave
until a half an hour later.

DEFENSE:
Here is the town of Blanton.

It's 15 miles
to the Nueces territory.

Sean O'Riordan was found here,

shot in the back.

Fifteen miles,
gentlemen of the jury,

from Blanton to the place

where Sean O'Riordan's body
was found.

The fastest horse
in this territory

couldn't possibly
make that distance

in less than 30 minutes.

At 6:30, Sean left
the Blanton cafe.

At 7:15, his body was found
by Sheriff Tom Bracken.

It is a known fact,
gentlemen of the jury,

that the morning
after O'Riordan was killed,

the Comanche tribe,

consisting of 75 men,
women and children,

picked up and left
that territory

for parts unknown.

How were you certain
about the time, sheriff?

Hasn't lost a minute
in five years

that I can remember.

It is my contention,
gentlemen of the jury,

that the Comanches killed

the Indian agent,
Sean O'Riordan,

under the mistaken belief

that he'd betrayed
their interests,

and that they then departed
before United States soldiers

could intercept them.

it has been testified

that Dr. Gene Matson was still
in the Blanton cafe at 7.

He could not possibly
have covered those 15 miles

in 15 minutes--

--to deliver that shot
as alleged.

to any thinking man

and it seems the witness
has disappeared

from the face of the earth.
