(gunshot)

- It's just habit, I guess.

- It's nearly been a week, Montana.

I'd say Taylor's probably
half way home by now.

- Yeah, maybe.

- We haven't really had much
of a chance to talk since...

- Since what?

- Well, since you kissed me.

- I didn't kiss you.

- No, I distinctly remember.

- What good reason would
I have to kiss you.

- Well, so it was an accident then was it?

- I guess it must have been.

(cheerful music)

(horses neighing)

- [Rob] What's up?

- What's this about?

- Daniel Larson, Crown Prosecutor.

Please dismount, miss.

- [Rob] What do you want her for?

What's going on?

- [Daniel] Is your name Hetti Lewis?

- That was my name, yes.

- I have a warrant concerning the murder

of one Edward Cawley in the
United States of America.

I'm placing you under arrest, Ms. Lewis.

Trooper.

- This is a mistake.
- Rob.

- You can't do this.

Now, we'd like to see Ms. Hale please.

- This is an extradition warrant.

- That's right.

Henrietta Lewis, otherwise
known as Montana Hale,

extradition to the
United States of America.

- On what charge?

- Murder.

A man named Edward Cawley.

- Taylor's father.

- Well, Taylor or Cawley
has been carrying out

a campaign of harassment against Ms. Hale.

He attempted to murder
both her and my son.

- I have heard your son's
accusations, Mr. McGregor.

- But you prefer to believe Cawley.

- This warrant was issued
my the attorney general

at the request of the American council.

This young lady is not
one of your constituents,

Mr. McGregor.

An American citizen

and as such is still
subject to American law.

- Montana is a permanent
resident and a land owner

and as such she's entitled
to certain rights.

- None of which matters in this case.

- We'll see about that.

I'm applying for a court
order for her release.

- You're wasting your time, McGregor.

The courts are not in the
habit of releasing murderers.

- And who says she's a murderer?

- She does.

A confession in her own hand,

signed in this office
not half an hour ago.

- Are you coming?

- No, I want to see if I can
get to the bottom of all this.

- Montana.

- [Montana] Hello, Rob.

- You alright?

- Yeah.

- They can't keep you in here for long.

- They'll keep me here
as long as it takes.

- You shouldn't have made that confession.

- Why not, it's true.

when I had the chance.

- Rob, it's not your

because someone's doing
someone else a favor.

- Yep, it seems the Department of Trade

has came from America
to buy Australian wool,

so someone's made a deal or a swap,

Montana for the wool.

Now, obviously, Cawley's father

had a fair bit of influence
back in his own country.

- So, Montana gets extradited

and we sell a few more bales of wool.

- A few thousand.

- A few million and it
still wouldn't be right.

- No, right or wrong doesn't
seem to come into this.

No, they're determined
that Montana's going back

to face trial.

- And the hangman.

- Isn't there anything you
can do through Parliament?

- No, I don't think anyone's going to risk

their political career by
buying into this fight.

- So, they're just gonna
stand back and watch her hang.

- They wouldn't care.

No, I'm gonna wire the attorney general

and demand an open inquiry.

- Tell him we want a hearing
or I'll publish the facts,

all the facts, including this trade deal.

- Sounds a bit like blackmail to me.

- Oh, I think it sounds
a little like politics.

(owl hooting)

- Your gun please, Mr. Taylor.

he couldn't have drawn

- And I'm sure Montana would

- Why would she confess?

If she didn't do it

- Who knows Michael but
if she did shoot someone,

you can bet she had a good reason.

- Is there any reason that
makes killing someone right?

- Sometimes.

- They'll still hang her, won't they?

- No, they won't.

Not if I've got anything to do with it.

Going somewhere?

We all want to help Montana.

The best way to do that is to use the law.

- What's the law gonna do, Dad?

- Well, I'm not sure.

She deserves a public hearing.

- So, she gets a public hearing,

they send her back to America
and then they hang her.

- It's all we can do, Rob.

- Look, I know how you feel about her,

just don't let it blow your judgment.

- Agreed to a public hearing for Montana.

- A little reluctantly by the tone of it.

- Well, I didn't think
our bit of blackmail

would do him much good politically.

- It does sound bitter.

Montana's more important

than my political career.

Rob, should we go and
tell her the good news.

- Matt, I'm sorry for all
the trouble you've gone to

but I don't want a hearing.

It's my choice.

- Montana, this is the
best chance you have

to explain everything.

- There's nothing to explain.

- I got you this hearing
because I have faith in you

because we all believe in you

but you're right, it's your choice.

Is there anything I can do
to make you change your mind?

- If you're not gonna fight for yourself

than do it for Danni and Michael and Josh.

They need to know, Montana.

They believe in you and if you give up now

it's like you're betraying them

and us.

this matter I understand.

We won't keep your from
your cows for long.

I must say I'm quite looking forward to

this maiden performance of yours McGregor

and I warn you now,

you'll get no sympathy for
your lack of experience.

This woman had ample opportunity

to call for qualified legal council.

- Well, considering Ms. Hale has been

threatened with an extradition order,

that's irregular to say the least,

I was hoping for a little
lead way in this matter.

- Then you thought wrongly.

Be thankful for small mercies, McGregor.

The woman's already confessed.

All we're doing is
giving her a little time

and wasting ours

and we're not winning
any friends in Melbourne.

- Now this isn't a formal trial,

it's just a hearing to see
if there's enough evidence

to warrant extraditing you to America.

- I understand.

- Montana, I can't help thinking that,

that you'd be better
off with a real lawyer.

- I want you, Matt.

- Now, both sides have got
the right to call witnesses.

We've got no one to support your version

of what happened in America.

- I won't testify.

- You have to, Montana.

- Why not?

- If they're planning on
putting a noose around my neck,

they can do it without my help.

- Montana, you've already
admitted to pulling the trigger.

Now, our only chance is to convince them

that you shoot Cawley's
father in self-defense.

- I won't do it.

I won't give evidence.

- I don't think I'm up to this.

I've got a little experience
in this sort of thing,

got nothing to work with.

If Montana is extradited,

if she does hang,

then I don't think I can live with myself.

- Well if that happens

then she's got no one to
blame but herself, Matt.

- Do you think she's guilty?

- She's confessed to
killing this Cawley man.

She told us she did it in cold blood

and she refuses to take the witness stand.

I mean, it's hard to believe anything else

and yet at the same time it,

it just doesn't ring true some how.

- In what way?

- I think she's hiding
something from them and from us.

- Yeah but why?

It just doesn't make sense.

- No, you know what we need to know

is how this Cawley man was killed,

what the actual circumstances were

and what his relationship was to Montana.

- I know all that but.

- Ruth Whitney, maybe she could find out.

She's working in San Francisco now.

If there's anything to find,
Ruth is the one to do it.

After all, I did teach
her everything I know.

- The hearing starts tomorrow

and all we've got to work
with is what we already know.

We're beaten before we begin.

- Into the frame, McGregor.

(gavel knocking)

- [Harry] When you're ready, Mr. Larson.

- Samuel Cawley is your real name.

- It is yes.

- And you are an American citizen.

- Yes I am.

- But very few of the good people here

would know you by that name,

they would know you as Sam Taylor.

- No, that's the name I
gave when I first came here.

- And why would you do that?

- Because I was looking for someone

and I didn't want to scare them off.

- Perhaps, you could explain.

- My Father, Ted Cawley,
was a rancher in Colorado.

Two years ago he was killed.

Shot down in cold blood.

- Was his killer caught?

- No, she was not.

She got away.

She left the country.

- Objection your honor.

- What, exactly, are you
objecting to, Mr. McGregor?

- The witness referred to
Edward Cawley's killer as she

and then looked directly at my client.

- Your client's been
charged for the killing

and has confessed.

There are no grounds for an objection.

I realize you're new to this, McGregor,

but I'd prefer it if you didn't try

playing at being a lawyer.

- I don't regard this
as a game, Your Honor.

- Neither do I.

Now, if you'll take your seat.

- So, your father's killer,

having shot him down in cold blood,

got clean away

and she left the country.

You followed?

- I swore that I was gonna find her

and bring her back to hang.

It took me quite awhile but
when I found out she had

money sent to Australia,

well that's when I came down here.

- Australia's a very
big country, Mr. Cawley.

How did you find the
woman you were seeking?

- Well, as soon as I had
heard of an American woman

buying a spread in the high country

and calling it Shoshoni Hills,

well I was pretty sure
that I had found her.

Shoshoni Hills was the
name of my Father's ranch.

- And that is the same woman?

- That's her, Hetti Lewis.

- The woman who now calls
herself, Montana Hales.

- [Sam] That's her, right there.

- As I understand it,
you made representations

to the American Council in Melbourne.

Who, in turn, sought to have the accused

extradited to America.

- That's correct.

It's obvious that she killed my Father

and the consulate agreed
to proceed with...

- You're learning, Mr. McGregor,

but I am a step ahead of you.

Just confine yourself to answering
the question, Mr. Cawley.

- [Sam] Yes, sir.

- Mr. Cawley,

I will ask you now to
tell his honor in detail,

exactly what happened on the day

of your father's death.

- He was getting on in years

and he was suffering from arthritis.

I had been working in New York city

but had returned home to help
him take care of the ranch.

- So, on the day in question, your father,

an elderly man suffering
from the rigors of arthritis,

was alone in his homestead?

- Yes, I had only been
back a couple of days

and I had been out working some cattle.

It was about three
o'clock in the afternoon.

I was returning home
when I heard a gunshot.

- Just one?

- Yes and then I saw a rider

galloping away on an Appaloosa.

- [Daniel] That is a very
distinctive horse, is it not?

- Yes it is.

- [Daniel] You didn't
chase after this rider?

- No, I did not.

I was worried about my Father,

so I just went inside.

- Tell his honor what you found?

- Well.

Pa!

I called out to my Father.

Pa.

Pa, Pa.

He'd been shot threw the heart.

No, no.

He was dead.

No, no.

No.
(sobbing)

- Do you have any idea why your father

might have been killed
in such a vicious manner?

- No, not at first, I didn't.

My Father didn't have
an enemy in the world.

Then a month later a man arrived,

said he was a banker,

and that the ranch belonged to him.

Said he had bought the land
off of Henrietta Lewis.

- Did he have any proof?

- He showed me the bill of sale,

supposedly signed by my Father
a week before his death.

- Do I understand that your
father had sold the ranch

without discussing it with you

or telling you of his intention.

- That's what it was suppose to look like,

like he sold it to her.

- To Henrietta Lewis, to Hetti Lewis.

The woman who now calls
herself Montana Hales.

- My Father would have
never sold that ranch,

never.

- But the banker had a bill
of sale favoring Hetti Lewis

and signed by your father.

How do you account for that?

- My father had,

had a lot of trouble with
the Lewis family before.

- You've got to be out of your mind.

- Sign it you murdering pig!

- I won't.
- Sign it!

- [Sam] She pulled a gun on him.

Forced him to sign the land over to her.

She made him backdate
it a week, obviously.

- You're not gonna get away with this.

(gunfire)

- [Sam] And then she shot him dead.

She must have made it
look like he was shot

in self defense.

- And in the belief that no
one had seen her vicious crime,

she went ahead and sold your
father's ranch to a banker.

- Up until the day that banker arrived,

the only clue I could give the Marshall

was that Appaloosa.

He informed me that she rode an Appaloosa,

much like the one I'd seen,

and then when I saw her
name on that bill of sale

I knew for sure it was her.

- You informed the United States Marshal

of your suspicions?

- Yes I did and he rode
out to question her

about my Father's death.

- And what was

Ms. Lewis's response?

- She shot him too.

(crowd gasping)

- Do you mean to tell this
court that the accused,

not only shot and killed your Father,

she also shot the marshal
who came to arrest her.

- Yes, that is exactly what she did.

- One moment, Mr. Larson.

(gavel knocking)

You wish to say something, Mr. McGregor.

- Yes, Your Honor.

My client admits to
having shot the marshal.

(dramatic music)

Why didn't you tell me about the marshal?

- I didn't kill him, I only wounded him.

It wouldn't have helped.

- He was a lawman, Montana.

No matter what reason you
had for shooting Cawley,

there's no way you can justify

shooting a United States marshal.

- So, what was the
point in telling anyone.

- Alright, that's it.

I don't care what you say

I'm putting you on the stand tomorrow.

- Come on.

(owl hooting)

- Montana.

- What are you doing here?

- I'm gonna get you out.

- Don't be stupid.

- It's your only chance.

- What sort of a chance would that be?

How long could I run
before they caught me?

- You can head north.

You can't let them take
you back to America.

- No, Rob.

I am not gonna let you do this.

I am not gonna let you
throw your life away.

They'll know it was you.

- I'm coming with you.

- How long would it be
before you regretted it.

Before you started to
blame me for everything

you had to give up.

- No, no, I wouldn't blame you.

- [Montana] Why not?

(gun clicking)

- Little late for a visit,
don't you think McGregor?

I thought you might try to do this.

- You wanna try and
stop me go right ahead.

- [Montana] Rob.

- You're a witness.

He was trying to bust her out of here.

- And what were you planning to do?

Now, off with you.

- I'll see you back in court.

- Don't even thing about it, McGregor.

(clamoring crowd)

- Never would have thought it myself.

- [Crowd Goer] You just
never know with some people.

- Montana, I want you to tell the court

something about your home life
before any of this happened.

- Is this really necessary, Mr. McGregor?

- Yes, I think it is.

- Very well.

- Montana.

- There was just my Mother,
my little sister and me.

We worked a bit of land,
tried to make ends meet.

As I grew up I started to get
work on the local ranches.

By the time I was 16,

I could rope and ride as well as any man.

- And shoot?

- Better than most.

- [Matt] Your Honor.

- Patience, Mr. Larson.

- Now you mentioned
your mother and sister.

I believe your grandfather
lived with you as well.

- Oh yeah.

- My Mother and Grandfather
had not been on good terms.

When my Mother got sick I wrote to him

and he came to live with us.

He worked day and night,
so I could nurse my Mother.

He did that until she died.

- But life wasn't always
this hard, was it?

- No, when my Father was alive

he owned a good spread.

He brought my Mother west
just after they were married,

when she was expecting me.

The land was good.

My Father worked hard.

We did well.

Then my Father was killed.

- How did your father die, Montana?

- He was shot.

I was the one who found him.

He died in my arms.

- And who do you believe shot him?

- Edward Cawley.

- That's lie.

That is a lie, Your Honor.

My Father never harmed a soul.

(gavel knocking)

- Mr. Cawley.

- Montana, why do you
believe it was Edward Cawley.

- Cawley was running
people off their ranches.

He'd burn their barns
and kill their cattle.

He just kept on wearing them
down until they'd leave.

Then he'd just walk right
in and take their land.

- That is a lie!

(gavel knocking)

- You're a liar, you're a liar!

- Warn your witness, Mr. Larson.

There's another outburst like that

and he'll be behind bars for a month

and I won't have to
extradite him to do it.

Ms. Lewis, you seriously expect this court

to believe that the law would allow Cawley

to shoot your father
and take over his land?

- Yes, Your Honor, I do.

- And the law did nothing?

- The law was in Edward Cawley's pocket.

The marshal was on his payroll.

It was my Father who named
our property Shoshoni Hills.

Cawley didn't even bother
to change the name.

- Carry on McGregor,

but you're going to need something more

than uncorroborated accusations.

- Montana, I want you to tell the court

what happened after the
death of your father?

- After we buried my Father,

Cawley arrived at our
ranch with the marshal.

They threw our furniture onto a wagon

and drove us off our land.

- Just like that.

- Just like that.

- My Mother was sick, I was 12 years old.

There was nothing we could do.

He said,

Cawley he said to my Mother,

if she ever came back,

if she ever said a word
about what had happened,

she'd not only lose her husband

but her two daughters as well.

(gasp)

- And what did you do then?

- Waited, grew up.

I practiced with a rifle
and my Father's handgun

every spare moment I had.

- Oh, why was that?

- Because one day I was going back.

I was going to avenge my Father's death

and I was gonna get back our land.

- You're not gonna get away with this.

- When I was ready I got
the bill of sale drawn up

and I took it to Cawley.

Sign it!

I'd grown some and he
didn't recognize me at first

but he did after I
showed him those papers.

I just held the gun on
him until he signed.

- Then you killed him.

- [Harry] Mr. Larson.

- More or less.

- [Harry] More or less?

- Well, once he'd signed that bill of sale

the anger, the hate, it
just seemed pointless.

It wasn't gonna bring my Father back.

Killing Cawley wasn't
gonna change anything.

I started to leave.

I heard him reaching for his gun.

(gunfire)

He drew first.

I shot him in self defense.

- Don't believe a word
of this, Your Honor.

This woman is an absolute liar.

- Your Honor, there is
not a shred of evidence

to this pack of lies.
(gavel knocking)

- Sit down Mr. Larson and you too, Cawley.

No one, not you Mr.
Larson, nor your witness,

needs to tell me how to do my job,

do you understand?

And as for you, young woman,

if you think that, that
is some sort of a defense

you're completely wrong.

You cannot, even in America,
walk into a man's home,

rob him and then shot him dead

when he tries to protect himself.

- I submit, Your Honor,

that my client didn't rob him of anything

that wasn't rightfully
hers in the first place.

- And as for you McGregor,

if that's the best you
can do for your client,

she'll be heading back home to face trial

on the next ship.

- I just don't know what
more I can do for her.

There doesn't seem to be anything left.

- I sent another telegram to Ruth.

Now, I was hoping I'd have
heard something by now.

- Well, it's a little too late.

Garfield's made up his mind.

We're just out of time.

- Then make some.

You know, you're all she has, Matt.

We can't give up on her,

not yet.

- All rise.

(gavel knocking)

- Time to sum up McGregor
and it had better be good.

- But the main witnesses to this hearing

haven't been called.

These witnesses are the people
here of Paterson's Ridge.

These are men and women
who know honesty and truth

when they see it.

Sometimes, like all of
us, they can get tricked

by lies and deceit

but in the end

they'll see a liar for
what he or she truly is.

Now these same people
have taken Montana Hale

into their hearts.

She's become a trusted friend

and they've learned to admire her

for her honesty and truth.

(tapping)

- Is it?

- Ruth Whitney, San Francisco.

- And when he'd been
exposed as the liar he is,

he made an accusation against this woman

but no friend could possibly believe

until Montana Hale confessed.

When a simple denial might have meant

an immediate dismissal of the
charges brought against her.

It might have meant
that she could stay here

amongst her friends,

amongst people who regard
themselves as her family.

She admitted to having killed a man.

To having wounded the marshal
who came to arrest her

and to having fled from the law.

Why?

Why has Montana Hale made
this unbelievable admission?

That's the question I want
you to ask yourselves.

What could possibly have been her reason?

Excuse me, Your Honor,
but I believe we might

be able to shed some new
light on these matters.

(scoff)

- You've had ample time, McGregor,

and I for one am still none the wiser.

- Then I'd like to ask for
an adjournment, Your Honor.

- No, no, no.

- Sit down, Mr. Larson.

An hour.

You have one hour, McGregor.

(gavel knocking)

(crying)

- Your sister's been trying to reach you,

to let you know.

He died peacefully with
your sister at his side.

I'm sorry, Montana.

- He did so much for us.

You know, he gave us
everything he had to give

and I tried.

I tried to pay him back.

- I'm sure you did everything you could.

- You know, when I settled out here,

I wanted to bring him out

because I wanted to treat
him to a better life.

You know, he deserved that.

- There's no point anymore, Montana.

There's no point in hiding
the truth, is there?

- No, I guess not.

- Now.

The truth.

Colin, I need you to do something for me.

Are you saying then that
what Montana told the court

was untrue?

That she lied?

- No, part of what she told you was true

but it wasn't the whole truth.

- It would be nice to hear the
whole truth, Mrs. McGregor,

that she'd be good enough
to share it with us.

- Well, it's true that Edward Cawley

signed the bill of sale for the ranch

with a gun held at his head

but it wasn't Montana Hale,

Hetti Lewis, who had her
finger on the trigger.

(gunfire)

The person who killed Edward Cawley

was Montana Hale's grandfather

and Sam Cawley failed to tell us

that there was not one
but two shots fired.

- Is that true?

- When her grandfather told
Montana what he'd done,

there was only one thing she could do

to save him from certain hanging.

So, when the marshal, the same marshal

who'd evicted her family
from her father's ranch

arrived to question her.

- [Marshal] I arrest you for
the murder of Edward Cawley.

- You leave her alone, you
ain't taken her no place.

- [Kathleen] Montana Hale took the blame.

- Fool.

- Don't touch him!

(screaming)

- [Kathleen] Unfortunately,
the marshal made a mistake

of taking too much pleasure in his work.

(screaming)

If she'd wanted to kill
that marshal she could have

but she didn't.

A little while ago I had
to bring Ms. Hale the news

that the grandfather
who'd helped raise her,

who'd struggled beside
her for so many years

had died peacefully in his sleep.

So, she doesn't have to
protect him any longer.

- Your Honor, this is just more lies.

I am telling you she killed my Father.

- Sit down Mr. Cawley and shut up.

I won't warn you again.

Mr. McGregor, it's an interesting story

but, unfortunately, hearsay is not proof.
