has brought criminal proceedings

against former President Donald Trump

for one of the most audacious
crimes in American history.

He's charged with conspiracy

to overturn the 2020
presidential election.

The former president
is going inside the building right now.

We may see a mugshot at the end of this,
the first for a former American president.

This film follows the people
investigating Trump's alleged crimes

before he has another chance
to reach the White House.

A criminal conspiracy
to overturn the results

of the 2020 presidential
election in this state.

The indictment brings felony charges
against Donald John Trump,

Rudolph William Louis Giuliani,

Stephen Cliffgard Lee.

We hear from those accused
alongside Donald Trump.

I practised my mugshot
for like two hours

because I knew it was gonna be history.

All of the prisoners all
the way down the long hall,

they were like, "Trump!
Trump! Trump!"

And I was like, "Yeah!"

John Charles Eastman.

I'm indicted co-conspirator
number three in Georgia.

We did nothing wrong.

Did I act like a mafia boss?
Of course not.

Do I think that Donald Trump
acted like a mafia boss?

Absolutely not.

Donald Trump was and remains convinced
that the election was stolen from him.

And we meet those clearing Trump's path
back to Washington D.C.

I believe that these cases were generated
to try to harm Donald Trump.

This is a political prosecution.

Judges,

jurors,

and witnesses.

It's a little intimidating

to take on the most powerful
person in the country

who makes no bones about
going after his enemies.

I got a text message that said,
"We're watching you. You better run."

We
will make America glorious again!

With the State of Georgia
once again back in the limelight...

So, Georgia, it is so good to be back.

And I am very clear,

the path to the White House
runs right through this state.

This is the inside story

of the prosecution of a president.

This is their last stop
before they'll go to archive.

We're using this.
We're running out of room.

Fani Willis is the district attorney
of Fulton County, Georgia.

I have no interest in headlines
or making a name for myself.

I'm in my dream job.

All I ever wanted to be since
I was a child is a lawyer.

Once I became a prosecutor,

there was no other job
more appropriate for me.

I hate bullies. I love what I do.

I wanna be a part of
keeping our community safe.

She's investigating Donald Trump's alleged
efforts to overturn the election.

- Are you nervous?
- Not at all.

He's the president, former president.

Not at all.

Her findings lead her to believe
that the president and 18 others

were engaged in a criminal conspiracy.

The case against him begins
on election night, 2020.

Polls have just closed
in half a dozen states.

The most closely watched
state at this hour is Georgia,

which President Trump almost
certainly needs to win

if he's to secure a second term.

In the key swing states,

the vote margins are razor thin,
especially in the State of Georgia.

A few hours earlier,
Trump was leading in Georgia,

but as results come in
from different districts,

it begins to look like
Trump might be in trouble.

Georgia right now.

President Trump's lead over Joe Biden

is continuing to shrink.

Democrats are dominating
the mail-in voting,

dominating with a capital D.

Major news networks

are projecting that
Biden will secure Georgia

and therefore the presidency
of the United States.

Ladies and gentlemen,

the president of the United States,
Donald J Trump.

At 2:30 AM,
whilst ballots are still being counted,

Trump takes to the stage
at the White House.

Well, thank you very much.

Thank you.

We love you!

- We love you.
- Yeah!

I appreciate it very much.

And I wanna thank the American people
for their tremendous support.

Millions and millions of
people voted for us tonight

and a very sad group of people

is trying to disenfranchise
that group of people,

and we won't stand for it.

The results tonight have been phenomenal.
We have won Georgia.

We're up by 2.5%,

or 117,000 votes,

with only 7% left.

They're never gonna catch us.
They can't catch us.

We were winning everything

and all of a sudden it
was just called off.

This is a fraud on the American public.

This is an embarrassment to our country.

We were getting ready
to win this election.

Frankly, we did win this election.

How are
you feeling right now?

America has decided.

We did it. We did it, Joe.

You're gonna be the next president
of the United States.

Trump now
has just eight weeks

before he must hand over the presidency.

He appoints former
New York Mayor Rudy Giuliani

as his lead lawyer to
challenge the election outcome.

Giuliani invites the press down
to an unlikely location

to deliver Trump's official response.

Well, let me... First of all, obviously
he's not gonna concede

when at least 600,000
ballots are in question.

It's not my job to determine
if the ballots are right or not.

It's their job.

They conducted themselves in a way that
suggests that there was fraud.

I voted for Donald Trump!

In Georgia,
Trump's claims are catching on.

Trump is the president!

- And will be for 4 more years.
- Yes!

I won't accept the illegal votes.
I won't accept the dumping.

You're gonna get all ballots

and all 100% of it is for Biden?

as they attempt to enter
a ballot counting centre.

My fears are they're gonna destroy
this nation.

we, the people,

we've won with the most votes

ever cast on a presidential ticket

in the history of the nation.

Hello, everybody.

Mr. President, do you have any big plans
for your last Thanksgiving

at the White House?

Well, we don't know what is last
if you look at what's going on.

You have to really take
a look at what's going on.

They're finding tremendous
discrepancies in the votes

and nobody believes those numbers.

Those numbers are incorrect
numbers and people know it.

That's why you have people marching
all over the United States right now.

They know it was a rigged election.

The people are very disappointed
that we were robbed.

We were robbed. I won that by hundreds
of thousands of votes.

Everybody knows it.
You go down to the streets,

there are Trump-Pence signs
all over the place.

This is Brad Raffensperger.
He's the secretary of state in Georgia

and the most senior
ranking election official.

President Trump
declared that he won Georgia.

And we just got a lot of, you know,
things that were alleged.

What were some of the allegations
that you were having to rebuff?

They said there was 2,400
non-registered voters. There were zero.

They said there were 66,000
underage voters. There were zero.

We did, actually, a 100% hand recount
of every single ballot.

We had five million paper ballots.

And they pulled them all out
and they started counting every county

and just added it all up to see
what the difference was.

And actually, President Trump
did come up short by 11,800 votes.

The secretary of state,

and whether he's Republican or not,
this man, what he's done,

he's an enemy of the people.

It became apparent that he was committed
to, you know, what he had been told.

And I was just committed to
the facts and the rule of law.

And they diverged.

At the end of the day, it was
just stuff that was made up.

But not all Republicans agree.

25 miles away, in a small
suburb in northern Atlanta,

lives Republican state
senator Brandon Beach.

Welcome to my home.
Come on in.

Like many in his neighbourhood,
Beach voted for Trump, and in 2020,

became a key Trump ally.

You know, MAGA stands for
Make America Great Again.

Who could be against
making America great again?

Ronald Reagan used that.

And Trump, that's all he wants to do,
is make America great again.

How could you be against that?

And people say,
"Oh, we're against MAGA."

I don't get it. I wanna make America
great again for my grandkids.

You know, I know him, and so I have
a tie to him, a personal tie.

And I want him to win.

In 2020, I was working on the Trump
campaign, so I was a Trump supporter.

I woke up and I thought he had won.

I went to bed and then I found out
he'd lost Georgia by 11,000 votes.

Well, I was shocked, number one,

and then I wanted to get to
the bottom of what happened.

That's my job as a state senator,
is to find out what happened.

So we said, "We're going
to have a committee.

We're going to look into
it ourselves as a senate."

Brandon Beach teams up
with other Republicans to investigate.

I hope we dig into it
and have investigations

and make sure this was a fair election.

Mr. Giuliani, are you a crook?

Miss, stop!

Mr. Mayor, would you talk about...

Trump's team decides to hold an urgent
hearing in the Georgia Capitol building,

claiming to have crucial evidence
of election fraud, a smoking gun.

Distinguished members
of the committee,

thank you very much for
giving us this hearing.

I represent President Trump.

I really appreciate the opportunity
to get these facts out.

We've had some difficulty
getting a hearing,

but I appreciate it very, very much.

Meanwhile,
Donald Trump is tweeting

that everybody should hear
this explosive evidence.

I would like to introduce Jacki Pick,

who is going to introduce our video.

So, I'm Jacki Pick,
and I'm here as a volunteer.

I am a lawyer, but I'm not acting
as a lawyer in this case.

I'm just helping out the legal team here.

A volunteer shows a surveillance tape
produced by Trump's team

that they claim shows election
fraud in Atlanta, Georgia.

We have the tape.
You're looking at one big room here.

This is where the absentee
ballots and military ballots

are being tabulated on Election Day.

And you have, back in that corner,

the press and the Republican observers.

So, according to the witnesses,
the Republican observers,

there is a lady who has blond braids

who comes out to announce,
"We're going to stop counting.

Everyone go home."
And in fact, we see that.

Everyone clears out,

including the Republican
observers and the press.

But four people stay behind.

Watch this table.

There you go.

So now they're gonna start pulling these
ballots out from under this table.

I'm gonna call it a suitcase,
containers for ballots.

You also have boxes.
Those are being moved around the room.

You'll see them move into action
and begin scanning ballots.

So, what are these ballots doing there,
separate from all the other ballots?

And why are they only counting them

whenever the place is cleared
out with no witnesses?

One of them had the name
Ruby across her shirt.

Two election
workers are singled out:

Ruby Freeman, a 62-year-old grandmother,

and her daughter Shaye Moss.

I was at that hearing.

A lawyer out of Texas got up.

Never seen her before,
had no clue who she was.

She would describe in detail
exactly what it was they were doing,

but she would always put a spin on it.

How many ballots
went through those machines

in those two hours when there was no one
there to supervise, to be present?

We believe that could easily be,

and probably is certainly beyond
the margin of victory in this race.

Do you have anything else that you'd want
to point out about the video?

- I think that's everything, right?
- That's everything for now, yes.

All right. Thank you.

Oh, I was disgusted, I was upset.
I said, "What's going on here?"

In the middle of the night,
they're counting votes.

Nobody's there to watch.

And everybody was supposed to go home.

And it's on video. They didn't know the
video was on from a previous concert.

Georgia election officials

immediately begin investigating
the claims that are being made.

We looked through,
because we are a law enforcement agency,

we had 48 hours of tape to look through.

We looked through it.
We catalogued everything.

It was found that,
as the count dragged on,

some election workers decided to go home,

but before they left, they placed ballots
that had not yet been scanned

in purpose-built ballot carriers.

You can see, I think, like,
58 minutes earlier that night,

they had placed the ballot carriers under
the table just to get them out of the way,

and they did it in plain view
of the monitors

and of the press who were all there.

However, election officials
wanted the count to continue,

so Ruby and Shaye, along with their
colleagues who stayed behind,

retrieved the ballots
and continued the count.

The Secretary of State's Office,
Georgia's Bureau of Investigations,

and the FBI carried out
a thorough investigation

and later found no evidence of wrongdoing.

When they showed it,

they said factually incorrect
things of what was going on.

They made claims that were not true.

That video and that kind of narration

probably was one of the single most
destructive things that happened.

Rudy Giuliani told state senators
that this election night video

shows people taking out
at least four boxes of ballots

and counting them after hours.

Still, at the time,
news networks broadcast the footage.

Trump supporters widely share videos

from Ruby Freeman's social media,
identifying her.

So, anyway, I'm going back to work now.

Hey, Renee. I love you all.
I love you all so much.

Thank you.
I'm glad you like my eyewear.

And Giuliani's
false claims continue.

Earlier in the day, these two were engaged
in another apparent voter fraud

in which they were
passing around USB ports

as if they're vials of heroin or cocaine.

I mean, it's obvious to anyone who's
a criminal investigator or prosecutor

they are engaged in surreptitious illegal
activity again that day.

And that's a week ago and they're
still walking around Georgia. Why?

Should have been, they should have been,
should have been questioned already.

Their places of work,

their homes should have been searched
for evidence of ballots.

It's available to 300
million Americans to watch.

Someday somebody is gonna say,
"What the hell did you do about it?"

Five days later,

Ruby Freeman phones the police.

An unknown man has been
knocking on her front door

and loitering on her street.

Half the night,
they've parked right up there.

Yes, ma'am.

And at seven o'clock this morning,
they was parked up there.

That's harassing.

Hey, what's going on?

Yeah, my name's Stephen Lee,
and I'm a pastor.

This is Reverend Stephen Lee,
a pastor who's travelled from Illinois.

So I'm part of law enforcement, sir,
out in California

Okay.

Yeah, she was calling about the vehicle.
She said a red Ford was acting suspicious.

- It's me.
- Okay.

I knocked on the door earlier.
And I've tried getting her messages.

You know, she's terribly spooked.
I'm not here to hurt her,

I'm not here to cause any problems
or anything like that.

I can verify who I am for you,
for your satisfaction,

but I also don't want to create
trouble either.

But it would be nice
if I could talk to her

and also get some truth
on what's going on.

Okay.

Prosecutors claim that the pastor
isn't visiting to offer moral support,

but is instead attempting to extract
a confession from Ruby Freeman.

I'll go over there
and see what she wants to do, but...

And if she doesn't want to,
you may wanna let her know that, you know,

I've got some pro bono service for her

if she's interested.

- Okay. You got some ID with you?
- Absolutely.

So the gentleman that was knocking
on your door, he's, I guess, a pastor.

He was saying that he was just trying
to get you some help if you wanted it.

- Oh, so you all talked to him?
- Yes, ma'am.

- I don't trust nobody.
- Okay, so you don't wanna talk to him?

No? Okay.

Even in the
presence of the police officer,

Ruby Freeman refuses
to speak to the pastor.

- I'm not interested. I have a pastor.
- Okay. Yes, ma'am.

I ain't no sinner.
I've got a pastor.

Prosecutors claim
that he then contacts an individual

in the Republican
campaign team in Georgia.

They dispatch Trevian Kutti,
a crisis manager.

She flies over 700 miles to make
direct contact with Ruby Freeman.

Ruby rings the police again.

Yes, I'm Ruby Freeman.

I have different people coming
saying it's just a matter of time

that they are going to come
out for me and my family.

I need an officer to come out.

Okay.
Have they made threats tonight?

No, but they want to talk
with me.

They've gone to my mom house
at her address, saying that I need help.

This time, they saying they
came all the way from Chicago

because they heard about the incident.

Who would come all the way
from Chicago to talk to me?

Cobb Police!

- You wanna come in?
- If you want me to, I can.

Okay.

They were saying that they had flew in,
she had flew in.

So somebody came to your door?

Yeah, these people
are coming to the...

People who know me would describe me
as someone who's nonstop.

You can't take no for an answer
when you have to solve the problem.

I'm a fighter fighting
for the best outcome

for the entire whole of the world.

My name is Trevian Kutti,
I'm a crisis manager.

I work for some of the biggest names
in the industry. I was given a call...

Trevian believes that the election is
stolen and that Ruby might be complicit.

She offers her services
as a crisis manager,

now that Ruby's identity
has been made public.

I got a call that a woman needed help.

And the person who I talked to said,
you know, "I can't go help her,

but there's just a situation going on.
But I know you can handle it."

So I went to see this woman.

Came to her home,

she didn't answer the door.

So, what I did was I said,

"Hey, this is who I am.
This is my number.

I'm leaving tomorrow.
I can meet today."

We don't have a lot of time,
but I'm here.

Let her know that we are not affiliated
with anything or anybody,

but there's some things she should know
and she should know immediately...

You know, right about now,

I don't know if I need to talk to these
people, if they really can help me.

My flesh wants to say, "Yeah,
they could wanna come after me."

You know, I ain't dumb.

So, what I wanted done was,

while you're here,
if you call them and say,

"Yes, she's willing to meet," you know,
"'cause the police is there.

And she'll meet with you
if the police is there."

Ruby is confused
by this series of unannounced visits.

She asks the police to oversee
her meeting with Trevian.

I get a call from a deputy

from the Cobb County
Police Department saying,

"Are you so and so and so and so?
Did you come to So-and-so?"

I said, "Yes, I did."

"Well, she'll meet you
at the police station.

So we all go to the police station,
and boom.

Thank you so much for
agreeing to meet with us.

We didn't wanna frighten you,
but we had to find you.

You are a loose end

for a party that needs
to tidy up what's loose.

They feel that you are loose for them,
and that's really why I'm here.

According to the prosecution,

Trevian is attempting to coerce Ruby
into admitting election fraud.

The stakes couldn't be higher.

If Trevian succeeds,

she'll give Donald Trump a real chance
to overturn the election result.

We would like to let you know,
first and foremost,

we have put in placement a way

what's on the table.

Ruby Freeman was not afraid of me.

We had a great conversation.
It lasted the course of an hour plus.

She was very comfortable.
She told her story.

She told what happened that night.

But I wanted to try and get her a lawyer,
that's what I was doing.

Okay.

And that was
the end of the conversation.

All right, we're gonna go that way.
I'm gonna be right behind you, okay?

She gave me her email.

And so I emailed her, she didn't respond.

I emailed her again, she didn't respond.
I left Atlanta.

But I was charged with attempting
to intimidate a witness

to give a false statement.

I truly believe it was a global effort
to stop Donald Trump's candidacy.

I can't wait to bring her to justice.
That's my job.

I was completely,

completely and fully wholesome
with this woman for her best interest.

Now I have to prove her wrong.

And I, you know, at her age, normally,

I would have sympathy, but in this case,

for the sake of this country, I don't.

Trevian Kutti
leaves Georgia empty handed.

Trump's team turn their attention
to another part of the election process.

They focus on Dominion,

the company that makes
the vote counting machines.

Look at what's happening in Georgia.

A lot of things are
being found in Georgia.

You have Dominion, which is very,
very suspect to start off with.

Those machines are fixed.
They're rigged.

You can press Trump
and the vote goes to Biden.

All you have to do is play with the chip.

And it's down, it's shown all the time.

All you have to do is play with the chip,
and they played with the chip.

They even name
an executive at Dominion.

One of the operators, Eric Coomer,

I believe his name is,

is on the web as being
recorded in a conversation

saying that he had the election
rigged for Mr. Biden.

His social media is filled
with hatred for the president

and for the United States
of America as a whole,

and they were going to f... Trump.

The man in question,
Eric Coomer,

has asked us not to disclose his location.

So we met him in an apartment
away from his hometown.

Hey, Eric, you
fucking piece of shit.

I hope you've picked out your cell
in Guantanamo Bay, you fucking faggot.

You were fully,

100% personally liable for acts of treason
against the people.

We will adjudicate you
and we will hang you for treason.

The November 2020 election was
one of the smoothest I've ever worked.

And I think it was about
six days after that,

I realised that somebody
was accusing me

of actually interfering with the election
and changing vote totals.

Rudy Giuliani and Sidney Powell went on
national television and I heard my name.

And I just, I left the
building, I went outside,

I think I chain smoked
a half pack of cigarettes

just trying to calm down,
and I really didn't know what to do.

Some private Facebook postings of mine
did express a certain political viewpoint.

But I was being accused of things
I didn't do that are provably false.

Fox News,
who ran with Trump's claims,

have since paid out over $700,000,000

to settle defamation
claims brought by Dominion.

All accusations that Dominion

or Eric Coomer tampered
with voting machines

have been proven false,
but the experience has changed his life.

I'm still afraid today, to be honest.

I was sitting there one
night and I literally,

I got a text message that said,
"We're watching you. You better run."

Take your time.

You know, I mean,
I jumped up out of my couch.

You know, all my blinds... I mean,
I haven't opened my blinds in years.

You know, at that moment, I really
thought, you know, I feared for my life.

Sorry.

I mean, it was devastating.

I was just doing my job.

Hello, America.

We have a great constitutional
scholar tonight.

- John Eastman, how are you?
- I'm well, Mark.

Dr. John Eastman.

It's at this point
that Trump decides

he needs some constitutional advice,
and he turns to a little-known expert

who sometimes appears on Fox News.

The special prosecutor,
the Department of Justice itself,

the attorney general have no
powers under our constitution

that aren't derived from the president.

Eastman is a professor
at Chapman University,

a small private college
in Orange County.

He remembers the first time
President Trump reached out to him.

I got a call from the White
House switchboard, it said,

"Please hold for the president."

Quite frankly, I thought it
was an old classmate of mine

pulling a prank on me, but no,
it was the president.

He just wanted to meet.

And we spent about an hour
and a half in the Oval Office

talking about a wide range of things.

Trump is intrigued
by Eastman's view

that the American constitution

gives the president more
power than people realise.

I've been attacked for just wanting
to be in the inner circle.

That's not true.
But it's a big deal.

I mean, representing the
president of the United States

in any case is a big deal.

I was brought in to try
and look at the legal strategy

to challenge whether
something phoney was going on.

When the Georgia state legislator
meet to discuss election fraud...

Eastman appears via Zoom.

Professor Eastman,
I believe you're gonna talk to us today

about the Electoral College process

and how that affects the legislature here.

Sure. Thanks very much.

And starts giving
them legal options.

Something is amiss here.

When you're convinced that the election
was conducted contrary to state law

and too fraught with the risk of fraud
to be properly certified,

then you should exercise
your prerogative

to legislatively designate
a slate of electors.

Eastman tells them
if they think that the vote is fraudulent,

they could find their own way
to decide who won Georgia.

This starts a chain of events
that some will claim

is an attempt to overthrow democracy.

In America, to become president

you need to win the Electoral College.

It is the most unusual
college in the country.

It meets once every four years.

A system that
allows different states

to have different values
according to their size and population.

California is the biggest,
with 55 Electoral College votes.

Georgia has just 16 but can be
crucial in a tight election.

The Electoral College process
is normally just ceremonial.

Each state appoints a group of individuals
to act as electors.

They represent the people
and certify who the state voted for.

And whoever receives the
most Electoral College votes

is declared the president.

I am so honoured to be
with this group today

as we officially cast Georgia's
16 Electoral College votes

for President-elect Joe Biden.

I was at the state senate

the day that the electors were
there and getting sworn in

and signing the official slate of electors

that would go up to Congress.

The electors
will take the documents

to a ceremony in Washington
D.C. on January 6th,

where the Vice President, Mike Pence,

has the role of confirming the winner.

While the official vote
is being signed off,

at the same time, on a floor below,

another meeting is taking place.

I saw Greg Bluestein,
who is the local political reporter here,

and I went up to him and I was like,
"Greg, what's happening?"

And he said, "I think something's,"

basically, "Something's up."

As I'm walking in,

I see a bunch of familiar
Republican faces,

and they're all piling behind
this giant wooden door, Room 216.

And so I go up, go in the door,
peek my head in, like, look around.

And I was like, "What's going on here?"

And the guy at the door, a bigger dude,
said, "Educators' meeting.

You can't come in.
Close the door."

- Did you see any educators?
- No.

Senator Jen Jordan
decides to burst in.

People were not happy to see me.
I just barged in.

Camera crews now enter the room.

I looked at Greg and I was like,
"What's happening?"

He said, "They're doing their own slate
of electors that will support Trump."

This group of Republicans are creating
their own form of document

that declares Trump, not Biden,
the winner in Georgia.

I was in the room.

We were really under a quick timeline
because our attorneys were saying,

"You have to have the electors in place

to preserve our opportunity
to win the state."

16 have been cast
for President Trump.

I'm called the architect of what they call
the, quote, "fake elector scheme."

And I was far from the architect.

I had no discussion with electors
except on this one point,

and that was the importance of meeting
and voting on that day.

And that's all my involvement was.
That was it.

I immediately just jump into an interview
with the Republican Party chair.

I'm like, "What's going on?"
Like, "What?

You know, you guys lost. The vote was
certified. Why are you doing this now?"

And he's saying,
"Oh, I'm here to preserve legal options,

just in case they overturn the election."

I felt like we were
doing the right thing.

It was very public.
The news media was there.

There was no secret meeting
that some people, you know, have said.

So I don't think anything was done wrong.

Brandon Beach,
when we interviewed him,

said you had, you know, the doors open,
this was a public event.

That's absolutely not true.

It absolutely was intended to be secret.

Now Trump enters the fray.

He calls Brad Raffensperger,
the secretary of state for Georgia.

Trump doesn't know that their
call was being recorded,

and these are excerpts from
their hour-long conversation.

Look, Brad,
I have to find 12,000 votes.

And I have them times a lot

and therefore I won the state.

I need 11,000 votes.
Give me a break.

The day that President Trump
and I had our phone call,

Patricia and I were at home.

And she kind of looked at me
and I kind of looked at her.

And you gotta think that
her dad grew up very poor,

they would never think that I'd actually
have a phone call, you know,

with the President United States
of America, neither did I.

And so I wanted to make sure

that I was respectful
to his position of authority.

Mr. Pres-uh,
you have people that submit information

and we have our people
that submit information.

And we have to stand by our numbers.
We believe our numbers are right.

You know, you don't care about anything.
Your numbers are right.

But your numbers aren't right,
they're really wrong.

So tell me, Brad,
what are we going to do?

We won the election and it's not fair
to take it away from us like this.

And you can re-examine it, but re-examine
it with people that wanna find answers,

not people that don't wanna find answers.

Well, Mr. President, the challenge that
you have is the data you have is wrong.

You should wanna
have an accurate election.

And you're a Republican.

We believe that we
do have an accurate election.

instead of keep saying

and it's leaked to the press.

And how did it feel
to know it had been leaked?

I'm not altogether surprised.

I don't know how many copies of, you know,
that conversation were made.

I would ask if we could kind of veer
to another topic

'cause that's something that
he's gonna be asked about

potentially in future proceedings.

The recordings?

News of Trump's
phone call is going viral.

His focus turns to his vice president:
Mike Pence.

He's the person in charge
of the Electoral College ceremony

that chooses the next president.

And with just 2 days to go, he says this.

You know, I'm here because I stand
with President Donald Trump.

You know, I know we all, we all got
our doubts about the last election,

and I wanna assure you
I share the concerns

of millions of Americans
about voting irregularities.

And I promise you, come this Wednesday,
we'll have our day in Congress.

We'll hear the objections.

We'll hear the evidence.

Donald Trump invites Mike Pence

to spend some time with Eastman
in the White House.

According to the prosecution,

Eastman and Trump would pressure Pence
to not certify the election.

So, I get asked to
come to the White House.

Donald Trump was and remains convinced
that the election was stolen from him.

I think he's right about that.

It was clearly an illegal election.

We had this meeting, it lasted an hour,
hour and a half.

And the vice president had his chief
of staff and his general counsel.

And the conversation
began by talking about:

Did the vice president
just have the authority

to unilaterally reject the Biden electors
because they were suspicious or contested?

And the president asked me just to explain

the underlying constitutional analysis
to him and to the vice president.

Trump argues that Pence has the power
to reject Electoral College votes,

but Pence seems to have concerns.

The vice president turned to me
at that point and said,

"Do you, like, think
I have such authority?"

And I... And, you know,
this is seared into my memory.

"Mr. Vice President, it's an open
question. It's never been resolved.

But that's why we think
you should accede

to the requests from
hundreds of state legislators

to give them a little bit time
to assess the impact of the illegality."

And that was the advice given
in that in that meeting.

Pence played this close to his vest.

He was actively suggesting
that he was gonna exercise some authority.

People were talking about the various
scenarios, which is why I was asked

to kinda put everything
that's being talked about

down on paper so that we kind
of know what the universe

of things we ought to be considering is.
And that was the extent of it.

Two men can be seen
arriving in Washington.

They're Trump's men
arriving with documents

certifying fake Electoral
College votes for Trump

to be given to Mike Pence.

Text message exchanges reveal
that they've successfully hand delivered

the fake elector documents
to a congressman's aid

who's agreed to pass them up the chain.

And what becomes clear
is that Trump's team

has been trying alternate
Electoral College schemes

not just in Georgia,
but in almost all the swing states:

Arizona, Michigan,

Nevada, Wisconsin,

all states that Trump lost.

In Washington, Trump has spent the morning
on the phone to Mike Pence

to persuade him to stop the certification.

He's also called on his followers,
who are now gathering in their thousands.

Americans were coming in
from every part of the country

by plane, by bus, by motorcycle, by
skateboard, however they could get here.

And so the rally organisers
called over to Rudy

and asked if he could
come say a few words,

and he asked me to go along with him.

Number one, every single thing

that has been outlined

as the plan for today is perfectly legal;

that the vice president can decide

on the validity of these crooked ballots.

As the crowd marches

The states will announce their votes
in alphabetical order

and Pence will have to decide what to do.

and make a list of the votes

As the crowd continues its march

This certificate from Georgia,
the parliamentarians advise me,

is the only certificate
of vote from that state

that purports to be a return from
the state and that has annexed to it...

Pence refused to accept
the Trump electors' certificates.

As I understand it,
they were all there with the archivist

and they just never got presented.

He refused to open any of those, saying,

"Because they didn't have a Governor's
certificate, then they're not valid."

He knew they were there.

He knew they were there.

Thank God he did the right thing.

That actually may have helped save
our democracy at the end of the day.

They dismiss
the Republican challengers

and Joe Biden is certified as the winner
of the 2020 presidential election.

The votes for president of
the United States are as follows:

is that a district attorney from Georgia

has been keeping an eye on him.

Fani Willis is
the most senior prosecutor

So what I've had them
do from all the floors

is bring all of the cases down.

that attempted to influence

the November 2020 election.

Willis has taken on

We need to have free and fair elections.

to make sure that we are patient,
that we take our time,

that we kind of ignore the public,

and that we just really look at the facts

special purpose grand jury,

What charges
could Trump face here?

Should he be worried?

He should

I mean, there are a host of charges

She'll present her investigation
to a jury of regular Georgians

who will meet and deliberate in secret.

We are here today to select a grand jury

that will investigate whether
there were unlawful attempts

to disrupt the administration
of the 2020 elections here in Georgia.

Judge Robert McBurney is the man
in charge of the jury selection process.

I had an armed escort to work.

200 people were brought
into the courthouse.

Big production.

And the special purpose grand jury
was selected from that group.

The jury
will be asked to determine

if there's enough evidence
to bring criminal proceedings

against Trump and those
working on his behalf.

My concern was someone
would have already decided:

"That person is a crook," or,
"This is all a political investigation."

There were people who
were willing to serve

who were very open-minded about it.

And so that grand jury selection
process went very, very quickly.

one of those jurors who,

under the condition of anonymity
due to fears for his life,

speaks for the first time on camera
about what happened in that room.

They were going
to present evidence to us

and we were going to be
the ones who recommended

and came up with that final report.

I think it being a former president

that we're investigating,

that's never happened
in the United States.

The jury hears gripping testimony
from Ruby Freeman,

the Georgia election worker

who was filmed counting
ballots on election night.

They accused me of committing crimes,

of helping to steal the election.

None of this is true, none of it.

I had to move out of my house
because the FBI said it wasn't safe.

Friends and members of my community

were afraid to even be
associated with me

because they didn't wanna get
caught up in the harassment.

There is nowhere I feel safe, nowhere.

I've lost my name
and I've lost my reputation.

and in a really good mood,

and waved to everybody and said
good morning, those kind of things.

Then he just, for the most part,
proceeded to plead the Fifth,

essentially no comment.

He was kind of one of
the ones that bothered me

because there's a lot of the people

who were out there saying
all of these things,

making all these allegations,

and when they was asked for
evidence or anything else,

there was no evidence to back it up.

You go into those senate hearings

knowing the impact that it's
going to have on these people,

or you know and you just don't care.

They're just throwing
whatever they can at a wall:

"Let's see which one of these stick."

The deeper Fani Willis
gets into her investigation,

the more she's asked about her decision
to take on such a high-profile case.

Are you worried that
former President Trump

could somehow be able to avoid,
delay, you know,

what's going on with your investigation?

- No.
- Why is that?

- What gives you that confidence?
- This is a criminal investigation.

We're not here playing a game.
I plan to use the power of the law.

And my job is to make sure that we get
the evidence that gives us the truth.

about games to delay this.

Next, jurors
are shown CCTV images

from inside an elections office
in Coffee County, Southeast Georgia.

In the footage, it seems
that a bail bondsman

with family ties to the Trump campaign

is giving instructions to computer experts

who appear to be hacking
into the Dominion software.

They use their own USB drives to access
sensitive voting data in Georgia.

That part was infuriating too.

All they're looking at is votes
and who voted for who.

That's private information,
and they just were able to go in there.

They could have looked up me personally

if I'd voted in Coffee County
and who I voted for.

I started realising that the criminality
was kind of there.

All the people, everything that happened
in Georgia kinda spiralled out

and had these tentacles going into,
you know, the White House.

Next, Dominion workers are called in,
including Eric Coomer.

We took the secret entrance
into the courthouse,

had an armed escort.

They just asked me questions.

I felt it was really important
to participate in this

and to try to bring to light
what are some of the outcomes

and sort of the ripple effects

of all of these lies and accusations.

You know, this isn't
about a specific crime.

This is about an all-out
assault on our democracy.

You know, a democracy
that's almost 250 years old

is really on the brink of being lost.

John Eastman is summoned.

The grand jurors themselves
were kind of seated auditorium style.

You know, there were tables upfront
and there were kind of auditorium seats.

Eastman is also being investigated
in other states.

Dr. Eastman, did you advise
the president of the United States

that the vice president could reject
electorates from seven states

and declare that the president
had been re-elected?

Fifth.

He also pleads the Fifth
or no comment to the special grand jury.

Most of these
people are attorneys,

devoted their life to the law,
and just to be that arrogant

to where you just think, "I can
just do what I want. It'll be fine."

I never was convinced that
Eastman and all of them

actually thought there was a conspiracy.

I think they were just saying it
to try and get to their end results.

I don't think any of those people
ever really believed most of it.

I don't think Trump ever believed
that the election was stolen from him.

I think they just say it
to get the impact they want

from the people who vote for him.

Once all these legal battles failed,

all you had left was January 6th,
where you could go and say,

"Let's put this on Mike Pence
to overturn this for us."

And he refused.

Without Mike Pence, I think you have
democracy overturned in United States.

While the special grand jury
deliberate the evidence before them,

Trump makes an announcement
from his Florida mansion.

The American people deserve to know

that President Trump and his advisers
didn't just ask me to pause,

return votes,

essentially to overturn the election.

I rejected that out of hand
